Response to Free allocation of emission allowances

The allocation formula for the hydrogen benchmark (ANNEX III number 6) should be amended to avoid adverse effects on specific installations in the chemical industry. Depending on customer requirements, those installations produce an aggregated synthesis gas with a high carbon monoxide fraction falling within the scope of the hydrogen benchmark. Although not intended by the overall benchmark systematics, certain product ratios of hydrogen to carbon monoxide lead to a significant low allocation of allowances for the specific plants, even though they still have unavoidable emissions. This is due to an unintended effect resulting from the technical rules for the application of the hydrogen benchmark and is affecting even the most efficient of the respective plants. In comparison with comparable installations, these plants have a considerable disadvantage in the production of certain mixing ratios, which is not justified by environmental effects. As a result, the competitiveness of such plants has already been affected throughout phase III of the EU ETS and will continue to decline in view of rising EUA prices in phase IV. More information on the described problem can be found in the attached expert report of FutureCamp, in which the problem of specific installations with the current allocation formula has been analyzed by using exemplary plant data. The report proposes a possible approach for an easy to implement solution, which neither affects other sectors nor changes the benchmark definitions and therefore is fully in line with the requirements of the EU ETS Directive.
