Response to Prolongation of the Consortia Block Exemption Regulation

The Freight Transport Association (FTA) is one of the biggest business groups in the UK, supporting, shaping and standing up for efficient logistics. We are the only organisation in the UK that represents all of logistics, including the buyers of freight services such as retailers and manufacturers whose businesses depend on the efficient movement of goods and who meet regularly as part of FTA’s Shippers’ Council. In November 2019, the European Commission published the results of its evaluation on the Consortia Block Exemption Regulation (CBER) and expressed its intention to renew it for a further four years. FTA, who responded to the original consultation, has reacted publicly to the announcement expressing its disappointment with the recommendation and disagreement with the conclusions drawn by the European Commission from its evaluation. The attached paper sets out the views of FTA shipper members and explains why shippers think that a renewal of the Consortia Block Exemption for another four years with no additional conditions or monitoring in place is neither justified nor desirable. It explains why a fair share of the benefits generated by the CBER has not been passed on to users, why shippers disagree with the European Commission’s analysis based on its 5 core criteria of effectiveness, efficiency, relevance, coherence and EU-added value and why and how the European Commission needs to radically revisit its approach to competition in the shipping sector.
