Response to Update of EU rules on radio equipment for reconfigurable radio systems

LPRA supports Option 0. According to our members, a delegated act should not be introduced at this stage, as no market issues have been identified related to this specific type of equipment, such as reconfigurable radios. Manufacturers are responsible for any software updates to their equipment, and these updates are fully validated to comply with the RED before deployment. Furthermore, with the RED delegated act activating Articles 3.3d and 3.3e, software updates are already an essential requirement. Additionally, the RED delegated act currently applies only to internet-connected products, toys, and wearables. However, it will be repealed within three years by the Cyber Resilience Act, which will apply to all products with digital elements, making software update obligations mandatory for placing products on the EU market. Therefore, software update compliance will be addressed for all products containing electronics. The short-range device industry has already been weakened by several difficult years due to the economic crisis; imposing additional burdens and costs would further hinder the industry's future. For these reasons, LPRA considers that the existing framework adequately covers the risks and recommends retaining option 0.
