Response to EU rules for the calculation and reporting of recycled content in single-use plastic bottles

LyondellBasell (LYB) welcomes the proposed draft implementing decision of Directive (EU) 2019/904, establishing a recycled content calculation methodology for single-use plastic beverage bottles. We support a clear, transparent and credible approach that recognizes chemical recycling of plastics - as a complementary technology to mechanical recycling - through the application of a fuel-use-excluded methodology for mass balance allocation, in line with existing legislation. LYB is a large multinational chemical and polyolefins manufacturing company that has anchored its strategy on sustainability. LYB is taking tangible steps to build a circular and low carbon solutions business at scale and has invested in a range of promising recycling technologies, including chemical recycling. Central to this effort is MoReTec, LYBs proprietary chemical recycling technology. LYB started construction of its first industrial-scale MoReTec plant in September 2024 at its site in Wesseling, Germany, with a targeted startup date set for 2026. LYB has received a 40 million award from the European Union (EU) Innovation Fund for this project. Our company has worked with value chain partners to identify common points we support in the proposed draft Implementing Decision. These are: 1. Recognition of chemical recycling supports our ongoing investments in reducing plastic waste and meeting recycling targets under the Single Use Plastics Directive (SUPD) and the Packaging and Packaging Waste Regulation (PPWR). It also supports voluntary commitments made by leading food and consumer goods companies and helps reduce reliance on virgin fossil resources. 2. The fuel-use-excluded methodology for mass balance allocation aligns with existing legislation (e.g., the Waste Framework Directive) and is consistent with industry standards (ISO 18604), positions taken by major consumer goods companies (Consumer Goods Forum), and civil society organizations (Ellen MacArthur Foundation, WWF). 3. By applying a strict proportional approach to dual-use outputs, the framework enables robust and verifiable claims about recycled content in materials and products. 4. The approach strengthens the European plastics and chemicals sector, fostering innovation and leadership in circular economy technologies and supporting the transition to a more sustainable plastics value chain. Finally, it is our belief that the Draft SUPD Implementing Decision is a positive and much needed step forward. We believe that this Implementing Decision should be the basis for future legislation such as the one defining calculation methodologies in the PPWR, as it creates the legal certainty needed to scale up chemical recycling in Europe. Moreover, this Implementing Decision encourages investment and the transformation of existing infrastructure toward circularity, as highlighted in Recital (6). To substantiate our analysis, we have attached a paper that provides evidence of the benefits offered by the current proposal. The attached technical document includes proposed amendments aimed at improving the clarity of the legislative language, consistent with our interpretation of its intent. To support these proposals, we added explanations of how specific articles relate to decision points across the recycling process, from waste to finished product. The annex contains a number of suggested changes that we believe are essential to accelerate the scale-up of recycling technologies capable of producing food-grade recycled plastics.
