Response to Delegated act on primarily used components under the Net-Zero Industry Act

Norge Mineraler AS, Norwegian mineral resource company developing a new integrated value chain for responsibly produced Critical and Strategic Raw Materials (CRMs) in Europe, welcomes the publication of the draft list of net-zero technology final products and their main specific components and the implementation of Net-Zero Industry Act (NZIA) as such. It is important to support the whole value chain of net-zero technologies in Europe and taking a more holistic approach beyond technologies themselves, including their individual components. This is precisely why we however believe that the list of primarily used components should also include the primary precursors the components listed are based on, especially those the EU is heavily import dependent on. A case in point is battery technology. Almost 100% of cathode active material (CAM) for lithium iron phosphate batteries (LFP) is produced in China; Europes LFP battery demand is fully dependent on this supply. Phosphorus (P4), a chemical component produced from phosphate rock, is a critical component for high-tech and chemical industries, including the production of battery electrolytes, selected LFP CAM and solar cells. To date, Europe is to 100% import dependent on this critical chemical component. With no production of its own (the last factory closed in 2012), 71% of P4 comes to Europe from Kazakhstan and 15% from Vietnam through an increasingly vulnerable and unstable railway connection via Russia and Belorussia. To support this critical value chain in Europe and thus to promote reliable, resilient and sustainable production of net-zero technologies in Europe, the list of primarily used components should also include phosphorus. Besides that, the list should also include other high-purity, low-contaminant products which are critical for net-zero technologies, such as battery-grade phosphoric acid and other battery grade cathode and anode component materials (such as iron phosphate, apatite phosphates, cobalt oxides, battery grade graphite etc.). As long as these critical precursors are not included in the NZIA and a truly holistic value chain approach taken, a stable, resilient and competitive net-zero industry in Europe cannot be developed.

We believe that Norway can play a decisive role in securing Europes access to minerals and critical raw materials. Contributing to the EUs objective of establishing a secure and diversified CRMs supply chain, Norway can reduce our dependence on third countries and support the EUs ambitious climate and environmental objectives. Norge Mineraler AS is based in southwestern Norway and has access to one of the largest phosphate rock deposits in the world from which critical raw materials such as phosphate, vanadium and titanium can be extracted. Here, phosphate and vanadium are among the critical raw materials relevant to the emerging markets of energy storage and battery production. Titanium is a critical raw material indispensable for the strategic technologies within defense and space applications. Our key feedbacks to the CRM Act proposal are the following. 1. Phosphorus should be recognised as a strategic raw material 2. Titanium should be recognised as a strategic raw material 3. The CRM Act must provide for grant support for production facilities for clean tech projects in Europe and EEA countries, and strategic projects in EEA countries should be eligible for funding Norge Mineraler AS would be able to reduce significantly the dependence of Europe's major economies on the current largest exporters of these minerals - China, Kazakhstan and Russia - and also support European and global efforts to reduce CO2 emissions in the coming decades, supporting the EUs ambition to be the first climate-neutral continent by 2050. We see that strategic self-sufficiency in minerals that are critical for the green and digital transition can only be achieved when mining and processing activities become competitive in the EU and EEA area. This means that the availability of financial support is what will determine if Europe is able to become more strategically self-sufficient. This view is reflected in our feedback, outlined below. Sustainable mining: the prerequisite to all The Norwegian Government launched its new Mineral Strategy on 21st June 2023, aiming to develop the worlds most sustainable mineral industry. Norge Mineraler AS supports this ambition, insisting that sustainable mineral extraction is a prerequisite to operate. We also aim to integrate waste rock and tailings management and handling as an integral element of our business model, which will see the best possible utilisation of resources. With that, we recognise the stringent environmental and sustainability requirements as reflected in the CRM Act and welcome it. -->>. Response to European Critical Raw Materials Act

Norge Mineraler AS welcomes the opportunity to provide feedback to the European Commission's initiative on a Critical Raw Materials Act. Norge Mineraler AS is an independent, privately-owned Norwegian mineral exploration company. It owns 61 exploration licences, covering more than 521 km2 near Stavanger in southwest Norway. Norge Mineraler AS welcomes the strategic partnership between Norway and the EU, given the importance of vanadium, phosphorus and phosphate in particular for the Green Deal climate objectives, the agriculture industry and food security in Europe and beyond. Agreement on the need for enhanced political and industrial cooperation between the EU and Norway on the strategic value chains of batteries and raw materials was enshrined in the Joint Statement agreed by Maroš Šefčovič, European Commission Vice-President and Jan Christian Vestre, Norways Minister of Trade and Industry, following the Green Industrial Roundtable on Raw Materials and Batteries in Oslo on 27 June. It emphasised the urgent need to tackle climate change and secure supplies of sustainable energy, critical raw materials and technologies instrumental to decarbonisation and the competitiveness of our economies. Norge Mineraler AS welcomes that President von der Leyen mentioned the forthcoming Critical Raw Materials Act in the 2022 State of the Union Speech on 15th September, referring to it as one of the most important legislative initiatives of 2023. Norge Mineraler AS also welcomes the Joint Statement between President von der Leyen and Norwegian Prime Minister Jonas Støre on 6th October in Prague on energy security in Europe where they agreed that promoting infrastructure investments for industrial decarbonisation will also bolster future stabilisation of energy markets and further the green shift to attain our common climate objectives, whilst strengthening European resilience. In addition to this, Norge Mineraler AS also welcomes the comments of VP Šefčovič at the European Parliament on 18th October as he and President von der Leyen presented the 2023 Commission work programme to MEPs, that without critical raw materials, there is simply no green and digital transformation. As highlighted by the EU 27 Member States, CRMs play a key role in ensuring EU strategic autonomy and limiting dependence on third countries. To support a closer partnership with reliable, trustworthy Norwegian CRM suppliers, Norge Mineraler AS believes that this legislation should oblige EEA states to facilitate fast-track regulatory processes on CRMs and enable grant schemes for extracting/enrichment processes, as a lack thereof could delay or potentially prevent access to a secure supply which is right here in the EUs own backyard. This is particularly important in the case of vanadium - derived from magnetite - phosphate and phosphorus, because at current market prices these minerals are not commercially viable to extract. Certain companies will need grants in order to proceed, particularly in a high-cost country like Norway, which operates amongst the highest ESG standards internationally, allowing for responsible and environmentally sustainable mining. As a reliable and trustworthy partner, located in a democratically stable neighbourhood country, Norge Mineraler AS is keen to support the EU in securing the supply of Critical Raw Materials (CRMs), making these available to the European market to help the EU achieve its climate and energy objectives to reduce CO2 emissions and ensure a successful energy transition.
