Response to Establishment of the scientific panel of independent experts under the AI Act – implementing regulation

The rapid evolution of AI needs continuous review and adaptation of regulatory frameworks. While the draft mandates a review of the panel's rules of procedure every three years, it lacks provisions for a broader review of the panel's mandate, composition, and effectiveness in light of technological advancements and emerging societal concerns. Periodic evaluation could help ensure the panel remains relevant and responsive to the evolving AI landscape. To address this, the following mechanisms could be implemented: - Regular Evaluation: Conduct comprehensive evaluations of the panel's performance at set intervals (e.g., every five years), assessing its impact on AI regulation enforcement, the relevance of its expertise, and the effectiveness of its engagement mechanisms. This evaluation could draw upon input from the AI Office, Member States, the panel itself, and external stakeholders. - Sunset Clauses: Consider incorporating sunset clauses into the legislation, requiring a reassessment and potential revision of the panel's mandate and operating procedures after a predetermined period. This would ensure that the regulatory framework remains responsive to technological advancements and evolving societal concerns. - Flexibility and Agility: Design the panel's structure and processes to allow for flexibility in responding to emerging challenges. This might involve establishing subcommittees focused on specific AI applications or granting the panel the authority to quickly convene expert working groups to address unforeseen issues.
