Response to Intellectual Property Action Plan

13 Aug 2020

We welcome the opportunity to provide feedback on the European Commission’s Roadmap for an Intellectual Property Action Plan. We agree with DG GROW’s analysis of the problems – 1) The EU’s IP system remains too fragmented 2) The uptake of IP in particular by SMEs and research centres is still limited 3) Tools to share out IP are insufficiently developed 4) There is still an unacceptable high level of counterfeiting and piracy 5) There is lack of global fair play Accordingly, as stated by DG GROW, the Intellectual Property Action Plan must include – 1) Upgrade the system for IP protection 2) Promote a better uptake and deployment of IP 3) Promote better licensing and sharing of IP-protected assets 4) Fight IP theft 5) Promote a global fair play Now, that the new Directive on Copyright in the Digital Single Market has been ratified, the Council discussed a Copyright Infrastructure, and the Commission mentions common European data spaces in its strategy for data, it is the time to connect the dots and propose an ambitious programme to protect authors’ moral and material rights and other intellectual property rights. Please find attached two streams of actions suggested from the point of view of creators, authors and rightsholders seeking to be rightly remunerated in the digital era – • Apply the challenging directive on copyright – linked to DG GROW’s suggested action items 1), 3), 4) and 5) • Link intellectual property rights and creative prosperity – linked to DG GROW’s suggested action item 2)

Response to Legislative framework for the governance of common European data spaces

30 Jul 2020

We welcome the opportunity to provide input to the European Commission’s plan to publish a regulatory framework on data governance for Common European Data Spaces. We prepared our feedback from the point of view of creators, authors and rightsholders seeking to be rightly remunerated in the digital era. As mentioned in our response to a previous consultation, aligning the directive on copyright in the Digital Single Market with the Copyright Infrastructure outlined by the European Council and the Common European Data Spaces defined in the EU strategy for data represents a great opportunity for the creative industries. It is now a question of recovery and resilience. Please find our comments in the attached .pdf file, adjacent to the paragraphs of the Inception Impact Assessment.
