Response to Evaluation of the Public Procurement Directives

Proposal for addition of a new paragraph 4 to Article 9 of the new revised Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement to Article 9 which reads: this Directive shall not apply to postal services provided by the designated operator in international traffic. It should be emphasised that the rules for the provision of postal services in international traffic by the designated operator are regulated by the Acts of the Universal Postal Union (UPU), a specialised agency of the United Nations, which regulate the scope, the manner in which these services are provided. The obligations of the designated operator and the provision of universal service in international traffic are regulated in the 2012 World Postal Convention. (Journal of Laws 2015, item 1522) and whether the Riyadh Convention of 2023. Article 1(1)(9) of the Convention provides a definition of the term Designated Operator, which is understood to mean any state or non-state entity officially designated by a Member State to ensure the provision of postal services and to fulfil, within its territory, its obligations under the Acts of Union. In turn, Article 1 item 1 point 14 stipulates that the universal postal service is a permanent provision of basic postal services of a specified quality to the customer at any point in the national territory at affordable prices. Article 3 of the Universal Postal Convention contains provisions on the universal postal service in cross-border traffic referred to in Article 13 of the Convention, i.e. letter mail and postal packages. Therefore, it should be pointed out that the issue of the way of provision, and therefore contracting of these services is regulated within an international organisation such as the UPU. In addition, postal services in international traffic do not include only the service of air transport of postal items of the postal operator itself, but they also include transport of postal items of other designated operators and only under the regulations of UPU. These are comprehensive services performed within the rigid framework of the UPU regulations. Currently, there is no such exemption explicitly in the Directive, which results in different approaches of the Member States to the implementation of this type of services. Interpretation problems arise as to what extent the Directive is to be applied to this type of service and whether it should be applied at all, given that the full scope of provision of these services is covered by the UPU acts.
