Response to A new Circular Economy Action Plan

Desde su experiencia como sistema integrado de gestión de aceites industriales usados, SIGAUS entiende que la aplicación de sistemas de responsabilidad ampliada del productor en la gestión de los flujos de residuo aporta, de manera muy relevante, la seguridad financiera necesaria para garantizar la correcta gestión de los residuos afectados. En este sentido, SIGAUS considera que uno de los flujos de residuos para los que sería conveniente aplicar, a nivel comunitario, el régimen jurídico de responsabilidad ampliada del productor es el de los aceites lubricantes industriales. De esta manera se constituiría un régimen jurídico europeo común en el que se fijen las obligaciones impuestas a los distintos agentes económicos que participan en el sector, más allá de las medidas normativas que han establecido algunos Estados miembros concretos en sus normas nacionales (como España y otros).
No obstante, en el caso que la Comisión Europea considerase que todavía no hay motivos suficientes para aplicar el régimen de responsabilidad ampliada del productor a los aceites lubricantes industriales, SIGAUS considera necesario que, al menos, se fijen objetivos obligatorios de regeneración de aceite industrial usado a nivel europeo, tal como ya se avanza en la nueva redacción del artículo 21.4 de la Directiva 2008/98/CE, del Parlamento Europeo y del Consejo, de 19 de noviembre, sobre los residuos y por la que se derogan determinadas Directivas sobre los residuos (en su versión dada por la Directiva (UE) 2018/851 del Parlamento Europeo y del Consejo, de 30 de mayo).
Based on its experience as an integrated management system of used industrial oils, SIGAUS understands that the application of systems for extended producer responsibility in the management of waste flows provides, in a highly relevant manner, the financial security needed to ensure the correct management of affected waste. In this sense, SIGAUS considers that one of the waste flows for which it would be suitable to apply, at the EU level, the legal regime for extended producer responsibility is that concerning industrial lubricant oils. In this sense, a common EU legal regime will be implemented setting out the obligations imposed on the various economic agents that participate in the sector, in addition to any regulatory measures that have been enacted by a few Member States in their own national regulation (such as Spain and others).
Nonetheless, in the event that the European Commission considers that there are not sufficient reasons to apply the regime for extended producer responsibility for industrial lubricant oils, SIGAUS considers that it is necessary, at minimum, to set mandatory targets for the regeneration of used industrial oil at an EU level, as already included in the new wording of article 21.4 of Directive 2008/98/EC, of the European Parliament and of the Council, of 19 November on waste and repealing certain Directives (in its amended version by Directive (EU) 2018/851 of the European Parliament and of the Council, of 30 May).
