Response to Digital package – digital omnibus

Skyscanner welcomes the Digital Omnibus as a chance to simplify the EUs digital rulebook while maintaining strong privacy protections and user trust. As a priority, we recommend the EU update the legislative framework for tracking technology towards a risk-based approach that reduces consent fatigue, incentivises the use of privacy-enhancing solutions, and allows organisations to collect important information more easily where privacy impacts are low. Furthermore, the EU should make targeted changes to GDPR to curb documentation-heavy processes that divert resources away from tangible privacy outcomes, enabling outcome-based compliance pathways. Streamlining overlapping assessments and improving timeliness and consistency in enforcement will help improve certainty for businesses and consumers alike. Taken together, these steps will modernise Europes data protection and privacy frameworks, strengthen the EUs digital competitiveness, and enable companies to more easily scale compliance globally - all whilst ensuring robust protections for individuals. Response to European Data Union Strategy

As a data-driven company, we welcome the EUs ambition to improve data sharing capabilities, simplify the existing regime and its application, and accelerate data-led innovation. We have provided detailed feedback on many areas of the proposed strategy in the associated questionnaire, but more broadly consider that this is an opportunity to establish the EU as a competitive destination for the digital economy. In particular, we submit that the current data protection framework could be more consistent, effective, and performance-based, which would support businesses across the digital economy whilst effectively increasing protections for users. We have outlined how this can be achieved in the attached paper.

Response to Revision of EU rules on air services

Skyscanner welcomes the European Commission's initiative to revise the Air Services Regulation and strongly supports modernisation efforts that enhance consumer choice and market competition. As a leading metasearch platform serving millions of European travellers, we understand the critical role that online travel intermediaries play in the air travel ecosystem by enabling consumers to compare prices transparently and access comprehensive flight options across multiple airlines. We are deeply concerned about the growing practice of certain airlines withholding content from indirect distribution channels, imposing discriminatory surcharges, and restricting access to fare, fee, and tax data, which directly contradicts Article 23 and undermines Recitals 15 and 16 of the current Regulation that guarantee consumers' right to compare prices effectively. The revised Regulation must explicitly prohibit channel-based discrimination by requiring airlines to provide non-discriminatory access to all fares, fees, and taxes across all booking channels, including metasearch engines and online travel agencies, without surcharges or technical restrictions. As such we recommend: - amending Recital 15 to state that consumers "should have access to all air fares and air rates irrespective of their place of residence within the Community and irrespective of the distribution channel chosen," - strengthening Article 23 to mandate that airlines transmit complete price breakdown datasets to any intermediary on a non-discriminatory basis through standardised APIs. Enhanced access to airline content would foster genuine competition, drive innovation in travel technology, reduce consumer search costs, and ensure that travellers can make informed decisions based on comprehensive market information rather than fragmented data controlled by dominant carriers. Current practices create an uneven playing field that risks unevenly benefitting large airline groups while harming smaller competitors and limiting consumer choice. We urge the Commission to include robust enforcement mechanisms and clear penalties for non-compliance to ensure that the revised Regulation delivers on its promise of transparent, competitive markets. Skyscanner stands ready to collaborate with the European Commission, Parliament, and Member States to create a regulatory framework that empowers consumers and strengthens fair competition.
