Response to EU rules on fighting against corruption

The Centre welcomes the initiative of the EU to update its rules on fight against corruption in the EU, while also considering closely the link between corruption and the rule of law, namely the contribution of corruption to the erosion of the rule of law. In this regard, the Centre also welcomes the focus of the European Commission in its annual rule of law report on monitoring the progress as well as challenges identified at the national level across all EU Member States in the area of anti-corruption framework as one of the fundamental pillars of the rule of law report. The Centre has been actively engaged in the European Rule of Law Mechanism since 2020, by participating in the submission of a joint rule of law report through the European Network of National Human Rights Institutions. In its country chapter, the Centre continuously contributes and provides information on the compliance of national legislation and policies of Slovakia with the existing international and European standards. It regularly provides updates on the amendments and achievements in the area of fight against corruption as well as it identifies and highlights the challenges remaining, including the adherence to international and regional standards and the implementation of recommendations of international and regional mechanisms, such as the Council of Europes Group of States against Corruption (GRECO) or the European Commission. The Centre particularly welcomes the initiative of the EU and its aim to also focus on monitoring and measure progress and challenges in the area of fight against corruption in the EU. It also particularly welcomes the inclusion of wide variety of actors in the process of monitoring, namely also from private, academic and civil society actors. With specific regard to measuring the progress achieved in the area of anti-corruption framework, the Centre has developed a practical tool that also focuses on monitoring and evaluating the performance of Slovakia in the selected areas of the rule of law. The aim of the created monitoring tool is to provide relevant and comprehensive information on the state of rule of law in the selected areas for all interested stakeholders, including scholars, legal professionals, media, members of civil society, businesses or wider public. Its functions enable to highlight areas where significant progress has been achieved, on the contrary to also alert to areas in which no progress has been achieved, or in which the standards deteriorated. Additionally, to the preventive and informative functions of the monitoring tool, it also aims to encourage and initiate a public debate on the need for further legislative and policy proposals or reforms in the areas of identified searing flaws. The first prototype of the created monitoring tool is available at the website of the Centre at: https://www.snslp.sk/en/rule-of-law-tracker/. The created rule of law conceptual framework which forms basis of the rule of Law tracker monitors adherence to rule of law via tracking the performance of Slovakia in six selected areas, namely protection of human rights and fundamental freedoms, functioning of the justice system, anti-corruption framework, media pluralism and media freedom, open government and government bounded by law, and enabling space for civil society and human rights defenders. For each area, additional objective indicators were carefully selected to measure the state of the rule of law. Evaluation of the data collected for particular indicator is based on comparison with a determined benchmark which was also carefully developed for each of the indicator. Besides the rule of law tracker, the other outputs, such as the rule of law conceptual framework and methodology of the tracker, or a short video presenting the tracker are also freely accessible to all interested stakeholders.

Druhá správa o dosiahnutých výsledkoch v národných prioritách implementácie Agendy 2030 (dostupná na: https://www.slov-lex.sk/legislativne-procesy/SK/LP/2022/229) predkladá odpočet implementácie cieľov udržateľného rozvoja a hodnotenie pokroku Slovenska pri dosahovaní Agendy 2030. Národná priorita „znižovanie chudoby a sociálna inklúzia“ spadá pod ciele agendy 1 (koniec chudoby), 2 (koniec hladu), 10 (menej nerovnosti). Jedným z aspektov, ktorým sa správa venuje je aj sledovanie vývoja príjmovej chudoby (v rámci indikátoru 1.2.1) na Slovensku, vyjadreného ako podiel ľudí pod hranicou chudoby, merajúc do akej miery finančné prostriedky domácností klesajú pod stredovú hranicu príjmu spoločnosti. V roku 2020 (posledný rok merania) bola miera rizika chudoby 11,4 % (po sociálnych transferoch), čo znamená že 615 000 ľudí na Slovensku malo príjem pod mesačnou hranicou chudoby, ktorá predstavovala sumu 435 eur. Správa spomína pozitívny vývoj v posledných rokoch, ktorý bol spôsobený vyrovnávaním príjmovej nerovnosti u domácností v nízkych príjmových pásmach. Ďalším relevantným indikátorom, ktorým sa správa venuje je aj podiel populácie pokrytej sociálnou ochranou (indikátor 1.3.1), podiel populácie žijúcej v domácnosti s prístupom k základným službám (indikátor 1.4.1), alebo prevalencia podvýživy (indikátor 2.1.1) a miernej alebo ťažkej potravinovej neistoty (indikátor 2.1.2).
Posledná Správa o sociálnej situácii obyvateľstva Slovenskej republiky za rok 2020 (dostupná na: https://www.employment.gov.sk/files/slovensky/ministerstvo/analyticke-centrum/2021/sprava-socialnej-situacii-obyvatelstva-sr_2020_pub.pdf.) uvádza, že na základe zisťovania EU SILC 2019 bolo na Slovensku v riziku chudoby alebo sociálneho vylúčenia 16.4 % obyvateľov (cca 877 000) ľudí. Správa uvádza pozitívny trend v porovnaní z výsledkami východiskového obdobia – roku 2008, od kedy došlo k vymaneniu cca 234 000 ľudí z rizika chudoby alebo sociálneho vylúčenia. Miera rizika chudoby bola v roku 2019 na úrovni 11.9% (muži 11.6%, ženy 12.1%), pod priemerom EÚ (16.5%), na tretej najnižšej úrovni v rámci krajín Európskej únie.
Z hľadiska rodovej rovnosti je Slovenská republika na posledných priečkach v rámci krajín Európskej únie – Slovenská republika v roku 2021 dosiahla celkové skóre 56 bodov zo 100 (priemer EÚ 68 bodov), teda 24.miesto. V rámci merania indikátorov v pracovnej oblasti získalo Slovensko 66.8 bodu (priemer EÚ 71.6) a ocitlo sa na 25. mieste. Na Slovensku pretrváva aj nerovnosť v odmeňovaní – za rok 2020 ženy zarábali v priemere o 15.8 % menej ako muži (priemer EÚ 13%).
