Response to Package travel – review of EU rules

The two purposes of the PTD are to improve consumer rights and the internal market. One important tool is the obligation for organisers to secure customer payments against insolvency. This proposal and the covid-19 pandemic further emphasize the importance of insolvency protection. Sunweb Group fully supports this purpose. However, as an international organiser, we encounter various limitations in obtaining insolvency protection. This restricts our EU guarantee fund, our customers and our own trade. We suggest to simple change tot adjust art 17(1), second paragraph, as follows: "Organisers not established in a Member State which sell or offer for sale packages in a Member State, or which by any means direct such activities to a Member State, shall be obliged to provide the security in accordance with the law of a Member State in which they offer there packages." In stead of 'in accordance with the law of that Member State'.
