Response to Digital Fairness Act

Supercell is a Finnish mobile-game company with offices in Helsinki, London, San Francisco, Seoul, and Shanghai. Since 2010, we have launched six globally successful titles - Hay Day, Clash of Clans, BoomBeach, Clash Royale, Brawl Stars and Squad Busters reaching more than 5 billion downloads and 250 million monthly players in over 120 countries. In 2024, Supercells revenue was 2.8 billion, more than one-third of which originated from Europe. Supercell welcomes the opportunity to respond to the Public Consultation for the Digital Fairness Act impact assessment. We align with Video Games Europe (VGE), the association representing the European games industry. However, since especially the proposed measures on in-game currencies would have far-reaching consequences, we wish to highlight our own experience, with following key messages: - In Supercells opinion there is no need for additional regulation on in-game currencies. Many of the issues raised by the Commission are already covered by existing EU legislation, some of which has only recently entered into force and lacks implementation experience. The current rules should first be tested in practice through enforcement and clarification of existing rules. - The free-to-play model is an established business model in the industry, and in-game currenciesearned through gameplay and in some cases purchased with real moneyare a fundamental part of it. The current proposals would require game companies to display the euro value of each in-game currency transaction when used during gameplay. This reflects a misunderstanding of how games function and would jeopardize the viability of the entire model. - Consumer-protection legislation should remain horizontal, general and proportionate in nature. Excessively detailed or overlapping rules risk creating a fragmented and unmanageable framework for consumers, companies, and authorities alike. New regulation should only be considered when a genuine and substantiated legal gap has been identified. - Player protection is at the core of Supercells business. Our mission is to create games that are played by as many people as possible, for years to come, and that are remembered forever. To achieve this, a positive player experienceincluding consumer protectionis central to everything we do. Companies own responsible practices and self-regulatory effortsdeveloped over years by Supercell and the wider games industryare not sufficiently recognized in the ongoing regulatory discussions. Reinforcing these proven practices would often achieve the same objectives as legislation. Please learn more about Supercell's views in our attached response.
