Response to Revision of the EU Emission Trading System Monitoring and Reporting Regulation (MRR)

SER’s response to the public consultation on MRR revision
Biogas is a carbon-neutral renewable energy which has a key role to play in the energetic transition, in full complementarity with renewable electricity. As such, it is important to promote sustainable biogas consumption for industrialists by recognizing it in the ETS.To achieve decarbonization, gas-consuming industries can resort to green gas consumption, which is sometimes - for technical reasons - the only solution. Thus, if the EU does not build an attractive system for biogas consumption, the risk is to see those industrialists leaving Europe and therefore increasing their negative impact on climate.
We suggest that the European Commission’s MRR takes into consideration the following points:
• Only one common methodology should be proposed in MRR as it will bring harmonization across the EU and prevent market distortions. The EU ETS system, being paneuropean, should give common rules to all ETS operators, as it is indeed the fact for every other biomass fuel recognized in the ETS.
• Choosing not to recognize biogas in the ETS should not be an option. Again, this exception does not exist for other biofuels
• In line with ongoing discussions to extend the EU ETS to the transport sector, provisions in the MRR should allow to consider also the carbon-neutrality of liquified renewable fuels such as liquified biomethane or liquified synthetic methane which is not necessarily transported via the gas network and is a key option to decarbonize transport.
Regarding methodology :
• The second methodology, based on the average gas grid biomass fraction, should be abandoned as :
i) it destroys a level playing field among ETS Operators : An operator in a Member State that will use ‘average emission factor’ may be disadvantaged comparing with an operator in a Member State using ‘purchase record’ methodology as it will not be able to claim a larger share of biogas in its consumption regarding the EU ETS scheme. Besides, industrialists connected to small grid with high biogas concentration will be unfairly too advantaged.
ii) it will stop incentives to biogas consumption as ETS operators would have no interest in buying biogas anymore, destroying a whole section of the green gas demand and annihilating a market-driven approach
• The principle of the first methodology, based on biogas purchase records, should be preferred as:
i) it is in line with the existing ETS regulation to which both biogas producers and industrialists are used.
ii) it gives ETS operators the tool to be pro-active in their gas consumption greening; and avoids competitive bias between industries from different Member States.
iii) it will make the green gas be more attractive to industrialists, thus foster further biogas development
o To keep using Guarantees of Origin as “purchase record of biogas”, as in the current MRR regulation. Nonetheless, in Member States that would decide not to grant GO for subsidized production, an option should be left to use another kind of biogas purchase record, that would respect the same conditions. Indeed, the GO system seems particularly fitted to fulfil the conditions required in the proposed methodology : it provides safeguards against double counting, already benefits from rules (through RED II) to assess if the GO value is properly taken into account in the support mechanism and benefits from standards that ensure that the GO information is accurate, reliable, and fraud-resistant.
o To add information about RED II’s sustainability & GHG criteria in order to facilitate the identification of GO that can be recognized in the ETS. Linking both documents (sustainability & GHG certificates and GO) is also key to avoid confusion and complexity derived from market multiplicity.
o To specify that “being connected to the same gas grid” means being connected to the European interconnected gas network, which should be considered as a single logistical facility.

La Commission européenne a mis en consultation publique un projet de règlement d’exécution qui vise à mettre en œuvre le dispositif de financement de projets d’énergies renouvelables à l’échelle de l’Union européenne, en application du règlement (UE) 2018/1999 sur la gouvernance de l’Union de l’énergie.
Merci de bien vouloir trouver dans le document ci-joint les remarques du Syndicat des énergies renouvelables (SER), qui s'articulent autour des 3 axes suivants :
1. Ce nouveau mécanisme ne doit pas conduire les Etats membres à réduire leurs efforts afin d’exploiter en priorité le potentiel d’énergies renouvelables sur leur propre territoire
2. L’intervention du mécanisme européen doit impérativement respecter le cadre règlementaire du pays hôte
3. L’intervention du mécanisme de financement européen peut avoir du sens lorsqu’il vient en complément de mécanismes nationaux
