Response to Delegated Regulation on data access provided for in the Digital Services Act

Mozilla Foundation welcomes the European Commissions draft Delegated Regulation on how outside researchers will be able to access data from Very Large Online Platforms and Search Engines under the EU Digital Services Act, in accordance with Article 40, paragraph 4. Our enclosed comments aim to ensure that non-academic and non-EU based researchers in particular will not face undue challenges in accessing data. We make recommendations in five areas, with a view to: 1. Allow applicants to amend proposals 2. Ensure data inventories are fit for purpose 3. Relieve the burden on the DSCE 4. Balance out the mediation mechanisms 5. Empower intermediary bodies to ensure security and equity

Response to Performance of independent audits provided for in the Digital Services Act

The Digital Services Act is poised to shape the platform auditing ecosystem for years to come, in the EU and beyond. This is therefore a critical window within which to foster a trusted and healthy auditing ecosystem, and to ensure the functioning of this key compliance measure. In our attached recommendations we encourage the European Commission to: 1. Build the foundations for a healthy, diverse and competent auditing ecosystem 2. Encourage the use of evidence from non-academic civil society experts 3. Ensure appropriateness of "audit criteria" and "benchmarks" 4. Ensure sufficient transparency and accountability of the auditing process itself

Response to Delegated Regulation on data access provided for in the Digital Services Act

The DSA must ensure public data for public interest research Our online environment today suffers from enormous information asymmetry: online platforms assemble information about us, while we know little about them. And while they share data with commercial third parties, the researchers who would hold them accountable to society or monitor societal concerns have had limited data access at best, and at worst, have faced technical barriers and legal threats. On April 26th, the Mozilla Foundation and a group of civil society experts gathered to discuss the implementation of the Digital Services Acts public data sharing scheme in practice. Together we put forward the attached recommendations in relation to Article 40, paragraph 12. This therefore pertains in particular to question 4 of this consultation.
