Response to Revision of Non-Financial Reporting Directive

TCO is positive about a new directive that has the ambition to strengthen existing rules introduced by the NFRD. The information in sustainability reporting is an important source of information for trade union work. However, the data must be comparable comprehensive, relevant, and reliable in order to make it possible to evaluate companies' impact on the environment, society and people.. TCO considers however that the proposal does not meet a number of important requirements: TCO would first like to stress the fact that the trade union movement has 200 million members worldwide who are present every day in workplaces that are subsidiaries, suppliers, or customers to EU based companies. No other stakeholder has such a good knowledge and experience of how companies respect human rights at the workplace in practice. The trade union's role in sustainability issues concerning workers’ rights and working conditions is central. Without the trade union contribution as a main stakeholder in the reporting process, the reporting will not achieve a sufficiently high quality or be complete enough to really contribute to sustainable business practices, specifically to assess the extent to which the company respects human rights and promotes trade union rights. TCO would therefore like to see a more ambitious proposal that strengthens companies' social responsibility and gives trade unions a strong role when it comes to sustainability issues in the workplace: - Formal consultation rights must be defined for trade unions and employee representatives in the reporting process, in the identification of social impacts and development of sustainability strategies, commitments and goals; - The Directive should explicitly include reporting on employees and social dialogue indicators, e.g. contract types, health and safety conditions, skills development, employee representatives on Boards, whistle blowing channels; - The Directive should refer to important reference texts on human rights and sustainable business, such as the OECD Guidelines for Multinational Enterprises and the UN Guiding Principles; - Unlisted companies in high-risk sectors and areas should be covered regardless of size (as demanded by the European Parliament, meaning sectors with a significant impact on sustainability matters). The Commission should provide an indicative, non-exhaustive and regularly updated list of conflict-affected and high-risk areas as well as specific guidance for SMEs; - Non-EU companies operating within the EU such as subsidiaries should be covered by the requirements so that there is a level playing field for all EU companies (as demanded by the European Parliament) - In addition, TCO emphasizes the importance of the EU Directive being in line with the EU's ambitions and existing legal frameworks in the field of sustainability, such as the Disclosure Regulation (SFDR), the Taxonomy Regulation and the forthcoming Directive on Due Diligence and Sustainable Boards. They should also be globally adapted by integrating and contributing to standardization initiatives at a global level. TCO would also favour the development of indicators for relevant social indicators.

Response to Strengthening the principle of equal pay between men and women through pay transparency

The initial position of TCO on the European Commission proposal for a pay transparency directive General remarks • It is of crucial importance that a directive on pay transparency and strengthened enforcement mechanisms is designed in a well-balanced and proportionate way. The directive should not interfere with national labour market models or national systems for pay determination. • Considering the statements as outlined above, TCO welcomes a directive that establishes pay transparency standards to strengthen the right to equal pay. The gender pay gap is a significant problem on European labour markets. Pay transparency is an important measure to prevent gender pay discrimination. • It is of crucial importance that the directive offers a possibility for social partners to maintain, negotiate, conclude and enforce collective agreements which differ from relevant provisions in the directive. A provision on collective agreements, similar to Article 14 of the directive 2019/1152/EU on transparent and predictable working conditions, should be introduced in the directive. • Several provisions in the directive proposal are considerably detailed, which makes them very difficult to evaluate and review at this point. The degree of detail will complicate the work ahead and ultimately the transposition of the directive into national law. Please see attached document for further comments. ________ TCO (The Swedish Confederation of Professional Employees) comprises 13 affiliated trade unions. The 1.4 million members of these unions are professional and qualified employees who share a major responsibility for important functions in society, although in a wide variety of occupations. They work in all parts of the labour market, for example in the schools, healthcare, trade, the media, the police, industry, IT and telecom. Over 60 percent of the members are women. Approximately half of the members work in the private sector and half in the public sector.

Transparens är en avgörande förutsättning för att motverka osakliga löneskillnader och diskriminering. Ur ett svenskt perspektiv finns i nuläget inte något behov av ytterligare reglering på Europanivå. Eventuellt fortsatta diskussioner måste ha som utgångspunkt att eventuella initiativ måste respektera till exempel den svenska arbetsmarknadsmodellen.

Tjänstemännens Centralorganisation (TCO) som är en facklig centralorganisation i Sverige välkomnar en reglering på EU-nivå till skydd för visselblåsare. TCO anser att det är en viktig samhällsfunktion att slå vakt om offentliggörandet av information som är skadlig för samhället och snedvrider konkurrensen samt att reglera ett effektivt skydd för visselblåsare i arbetslivet, inte minst för arbetstagare. TCO är alltså i grunden positiv till ett EU-direktiv om skydd för visselblåsare och förslaget innehåller flera mycket bra regleringar, till exempel det omfattande repressalierförbudet. TCO har dock synpunkter och kommentarer som framgår av bifogad fil.
