TUSIAD Urges Pilot Phase for New Carbon Reporting Rules

Response to Sustainable Products Initiative

TUSIAD - Turkish Industry & Business Association perceives Green Deal as a model of economic growth focusing on fair and inclusive development for all. In this respect, Paris Agreement and European Green Deal are among our strategic priorities. Since its inception in 1995, EU – Türkiye Customs Union has been mutually beneficial for EU and Turkish companies. Türkiye, as one of the EU’s main trade partners, is highly integrated to the EU economy based on this unique framework. In view of the unique relationship between the EU and Türkiye stemming from the integration partnership and Customs Union, the alignment of Türkiye with the requirements of Ecodesign for Sustainable Products Regulation (ESPR) should be addressed in a comprehensive manner with the spirit of close cooperation. To avoid additional disruptions in the value chains during the COVID-19 recovery period and to enhance Europe’s open strategic autonomy, the stakeholders on both sides should work together and ensure the activation of effective mechanisms that would bring Türkiye closer to the implementation of ESPR requirements, including the DPP. Turkish business community supports every action that would facilitate the trade and economic partnership between the EU and Türkiye, while preserving Türkiye’s integration process to the EU as the main framework of progress for institutional reforms and business environment. We would like to take the opportunity of sharing our views on the draft legislation on ESPR, including the establishment of a Digital Product Passport (DPP), which will enable products to be identified and linked to data relevant to their circularity and sustainability. DPP is one of the key requirements that Turkish companies, which are key actors of various important value chains, need to comply with. To deliver on the ESPR’s objectives, TUSIAD stresses that a strong dialogue with the EU’s main trade partners is of utmost importance. Non-EU companies that take part in the same value chains with EU companies should be able to actively engage with the ESPR process, including the Ecodesign and Energy Labelling Consultation Forum and any platform that is to be established to deal with Sustainable Products Initiative, and future consultations on upcoming delegated acts or self-regulatory measures. PROPOSAL FOR ECODESIGN FOR SUSTAINABLE PRODUCTS REGULATION CHAPTER I - GENERAL PROVISIONS The definition of destruction of unsold consumer products should be clearer. Recycling or refurbishment operations should not be considered as destruction, as they are inherent in the circular economy. CHAPTER II - ECODESIGN REQUIREMENTS Sound functioning of the European single market is of paramount importance. Therefore, the new regulation must be designed so as not to impair free circulation. Burdensome practices that will massively increase the time spent at the customs checkpoints should be avoided. Issues that are currently regulated by existing regulations should not be re-regulated with the new Eco-design regulation. In particular, substances of concern that are currently regulated by REACH and ROHS regulations, while being regulated in ESPR, invites double regulation. The scope of requirements for each product group should be studied individually. Providing irrelevant information to the consumer will confuse them further and make the sustainable product selection process more complicated than it is now. Instead of specifying requirements on the basis of each product, requirements should be determined on the basis of product groups. For instance, energy consumption during the use phase (during usage) has no relevancy nor application to textiles. Kindly see the attachment for the complete text.

Response to Carbon Border Adjustment Mechanism

Effects of the climate change are being widely observed in Turkey and are on TÜSİAD agenda’s foreground. In this respect, Paris Agreement and European Green Deal are our strategic priorities. TÜSİAD perceives Green Deal as a model of economic growth focusing on fair and inclusive development for all. As one of the main economic partners of the EU, Turkey will be on the top of the list of the countries that would be affected by the upcoming legislation on Carbon Border Adjustment Mechanism (CBAM). Therefore, we would like to specify hereby, major concerns of the Turkish business community vis-à-vis CBAM. In view of the unique relationship between the EU and Turkey stemming from the integration partnership and Customs Union, the alignment of Turkey with the European Green Deal, including the carbon pricing and greenhouse gas emissions reduction targets, should be addressed in a comprehensive manner with the spirit of close cooperation. To avoid additional disruptions in the value chains during the COVID-19 recovery period and to enhance Europe’s open strategic autonomy, the stakeholders on both sides should work together and ensure the activation of effective mechanisms that would bring Turkey closer to the emerging system in the EU. To achieve a sustainable development model and to avoid potential adverse effects stemming from the CBAM, such as detrimental impact of heavy financial burden on green transformation efforts of the Turkish companies that are exporting to the EU, establishing an ETS in Turkey would be essential. Hence, a fair and transparent assessment of emission tracking infrastructure by the EU is of critical importance. Establishment of a legally sound and effective cooperation mechanism in early stages of CBAM legislative process would be crucial to guide the systematic alignment efforts. For instance, Turkey’s participation in the CBAM working groups and consultative committees at EU level could be considered. In the meantime, providing country-specific assessments and transitional periods adjusted to the countries’ different development level and establishing consultation mechanisms to support and facilitate their green transition, as well as providing options for access to funds would be critically important. A part of the revenue generated from CBAM should be used to finance green investments in the countries that are closely connected to the EU via comprehensive trade and economic agreements or Customs Union partnership, which ensures regulatory alignment and high level of market integration to the EU, such as Turkey.
