Response to Postponement of deadlines within the Accounting Directive for the adoption of certain ESRS

14 Dec 2023

The European Commission committed itself to reducing burdens associated with reporting requirements by 25%. In order to relieve undertakings subject to reporting requirements, the Commission plans to give them sufficient time to prepare for any new reporting requirements. The proposal to amend Directive 2013/34/EU with regard to the time limits for the adoption of sustainability reporting standards for certain sectors and for certain third-country undertakings is related to this. The sector-specific standard for the mining, quarrying and coal sectors (MQC) is considered as pilot standard. As an association of the raw materials extracting industry in Germany and thus as a representative of undertakings affected by the MQC standard, the Vereinigung Rohstoffe und Bergbau e. V. (VRB) welcomes the opportunity to comment on the Commission's proposal EFRAG and the Commission should use the time they have gained to examine the need of sector-specific ESRS and the disclosure requirements contained therein in detail. This applies in particular to the almost finalised first sector-specific ESRS for the so-called high-impact sectors, to which the MQC standard belongs. In addition, the tow-year postponement must also not affect any transition periods planned for reporting standards. They shall be postponed accordingly. Transition periods are important for undertakings in order to be able to integrate sustainability reporting into all processes compliant with CSRD. Until the Commission enacts new standards, the next two years should therefore be used to evaluate the cost-benefit ratio of reporting requirements for undertakings and to consistently reduce reporting in line with the Commission's own requirements. Our detailed statement is attached.

The Vereinigung Rohstoffe und Bergbau e. V. (VRB) is a business association of the German raw materials extracting industry. Its members are associations from the hard coal and lignite industries as well as the extraction of iron ore, shale, refractory clays, gypsum, graphite, kaolin and quartz. VRB also includes federations of post-mining, reclamation and mining environmental protection. VRB welcomes the adjustments made by the Commission. However, critical points remain, such as the general scope of ESRS Set 1 or the reporting requirements, on which VRB comments in the attached document.
