Evaluation of the 2008 European Critical Infrastructure Protection Directive

The Commission will launch an evaluation of Council Directive 2008/114/EC of 8 December 2008 on the identification and designation of European critical infrastructures. The evaluation will analyse to what extent the Directive objectives are achieved and assess its effectiveness, efficiency, relevance, coherence and EU added value. The presentation of the results of this evaluation is planned for end 2018.

Microsoft wants the directive updated to focus on hybrid conflict threats rather than expanding to cover ICT sector. They argue the NIS Directive already addresses cybersecurity for essential services, so the critical infrastructure directive should tackle gaps in international law around nation-state attacks that combine traditional warfare with cyberspace operations.
This would avoid duplicate cybersecurity obligations already covered by NIS Directive.
