Response to Digital Fairness Act

Adevinta welcomes the opportunity to provide input to the European Commissions consultation on the proposed Digital Fairness Act (DFA). We welcome the overall ambition of the European Commission to ensure a fair, transparent and trustworthy digital environment, which provides a high level of protection to European consumers online. However, we believe that the current European consumer law framework, including the Digital Services Act, Unfair Commercial Practices Directive and General Data Protection Regulation, remains fit for purpose to address many of the problematic practices identified by the Commission. We believe that instead of creating new rules for European businesses, current rules should be consistently and coherently implemented and enforced to reach a proper balance between consumer protection and competitiveness. Our response focuses on four practice areas that most affect our business and the online marketplace industry: (1) manipulative interfaces, (2) addictive designs (3) digital advertising, and (4) subscription cancellation and withdrawal. Across these topics, we support outcomes that enhance consumer protection, accessibility, privacy, and trust while preserving clarity and legal certainty for European businesses and SMEs. Beyond these four focus areas, Adevinta encourages the Commission to prioritise horizontal enablers that make the existing legal framework operate as a coherent whole: strengthen coordinated and consistent implementation and enforcement across Members States; and advance simplification including the forthcoming digital omnibusto streamline overlapping duties. Maintaining stability of settled concepts (such as the reasonable consumer) and avoiding undefined constructs will preserve legal certainty, while co-regulatory tools (codes of conduct, sandboxes, best-practice exchanges) and investment in digital literacy and awareness can raise standards quickly without new hard-law layers. Adevinta stands ready to constructively contribute to the Commissions agenda to deliver tangible, meaningful benefits for European consumers while preserving legal certainty and consistency across the digital economy in the Single Market. Together, our marketplaces attract more than 120 million users every month and over a million businesses. Our loved local brands include leboncoin in France, Germany's leading sites mobile.de and Kleinanzeigen, Marktplaats in the Netherlands, Fotocasa, Habitaclia and InfoJobs in Spain and Subito in Italy. We employ over 5,200 individuals globally to power our marketplaces. This includes more than 2,500 experts working in product and technology. Adevinta acknowledges that children face specific risks online and recognizes the industry's responsibility to help ensure their safety as users. Online platforms play an important role in building trust in the digital services used by users, particularly minors. Adevinta welcomes the European Commission's forthcoming Guidelines aimed at helping online platform providers implement appropriate and proportionate measures to ensure a high level of privacy, safety, and security for minors using their services. In the attached submission we focus in particular on: - The Guidelines for compliance with Art. 28 DSA should not entail the equivalence of the requirements for VLOPs under Art. 34 and 35 DSA. - Child risk assessment: the "5C" approach departs from the mandate of Art. 28 DSA - The Guidelines should take a flexible stance to the assessment of risks and potential mitigation measures and should catalogue existing best practices. - Harmonisation and regulatory intersectionality
