Response to Amendment of Directive (EU) 2016/798 on railway safety as regards the application of safety rules in the Channel Tunnel

ALLRAIL, the Alliance of Passenger Rail New Entrants in Europe, represents independent passenger rail companies - railway operators and ticket vendors. We promote competition in the passenger rail market, aiming for EU regulatory environment that will encourage the introduction of more innovative & attractive rail services. ALLRAIL strongly supports the proposed regulation and decision. The upcoming withdrawal of the United Kingdom from the European Union creates specific challenges for railway services through the Channel Tunnel from the United Kingdom to France and beyond. Such upcoming changes should not represent a step back, the respective roles and responsibilities of the entities granting safety certifications for the “areas of operation” in the United Kingdom, the Channel Tunnel and France should be stable and reliable for operators applying to carry out services. Therefore it is necessary to keep the Status Quo and have a single safety authority responsible for the whole of the Channel Tunnel. Any other approach of applying different standards to the same tunnel would be expensive as well as impractical. It may also discourage new entrants from enter the cross channel passenger rail market. As the Channel Tunnel is structurally and operationally a single piece of railway infrastructure, we recommend that a single safety authority responsible for the whole Channel Tunnel is maintained. Due to the fact that on a small part of the European railway network between the United Kingdom, three areas of operation require multiple applications for safety certificates, requiring complex applications based on vast safety management systems, we recommend to keep the status quo regarding the entities granting safety certification for the above described areas of operation for the sake of safety, legal certainty and attractiveness for new businesses.
