American Express supports the initiatives by the Commission encourage instant payments across the EU. The design of such initiatives should consider all possible barriers to instant payments to ensure further adoption by consumers and businesses alike. A more developed instant payments infrastructure will open opportunities for payment initiation and acquiring in particular. It will also allow for the development of APIs and other payment arrangements. In order to better establish the regulatory and policy framework for this, American Express urges further attention to be paid to issues arising from the Payments Package which have not fully addressed persistent issues around the lack of competition in the payments landscape, protection of consumer choice in payment products, and spurring innovation. The success of instant payments will in large part depend on non-bank PSPs having direct access to the intra-bank payments systems, as being discussed in the Settlement Finality Directive. Under the current settlement arrangements for SCT Inst, payment institutions can only be indirect members of the TIPS ECB clearing arrangements, thus putting non-bank payment sector at a competitive disadvantage. American Express welcomes the fast evolution of the SCT Inst adherence rate and the growth of SCT Inst volumes of transactions. American Express fully supports the European Payment Council’s (EPC) work to actively promote adherence to SCT Inst and its efforts to foster the scheme’s attractiveness and reach. We also support the overall objective pursued by the Eurosystem’s interoperability initiative to facilitate full pan-SEPA reach. American Express advocates for a real level playing field, which does not primarily benefit dominant players. Challenges remain for alternative players to compete and scale, due in part to unintended consequences arising from the Interchange Fees Regulation and PSD2, particularly rules on Open Access, separation of processing and scheme. American Express agrees with the Commission that a European instant payment infrastructure could strengthen the role of the euro. Instant payments at the Point of Interaction (POI) could be complementary to card payments. The EU should focus on further regulatory harmonization for the payment sector. Harmonization would ensure more consistent payment experiences within the EU, which in turn would contribute to the successful rollout of pan-EU solutions. American Express believes that payment service providers should participate in a single set of rules, practices and standards by also adopting international standards. This will help guarantee interoperability not only within the EU, but also at a broader scale. Compared to the traditional credit transfers, instant payments pose additional or increased risks (in particular for fraud or money laundering). There may be a range of practical and legal issues associated with instant payments from cases in Europe where mandating a rapid payment mechanism or settlement times can result in: - Higher settlement costs to merchants; - Decreased merchant choices; and a - Loss of protection for consumers (e.g. chargeback rights). Experience from bank-to-bank payment methods in Europe also shows a low level of awareness among consumers of the protections in place and the differences among payment solutions. We support the additional work proposed to raise greater awareness among consumers. In the light of the comments made, American Express would support Policy Option Two (2), the non-legislative option, which would explore possibilities of actively promoting the voluntary participation of PSPs in relevant standardization processes or schemes, awareness raising campaigns among consumers and merchants, and establishing a structured dialogue between national payments sectoral groups to coordinate national plans for promoting instant payments or collaborating on a Commission Recommendation to Member States.

Response to Report on the application of the General Data Protection Regulation

American Express is pleased to have the opportunity to provide comments for the upcoming European Commission report on the application of the General Data Protection Regulation (GDPR). American Express has welcomed the entry into force of the GDPR which has brought a necessary alignment between national data protection legislations across Europe and has overall increased the protection of our customers. Data protection and information security are long-standing priorities for American Express and our existing robust data protection program was enhanced to meet the additional requirements introduced by the GDPR. In the implementation of these new requirements, American Express has however faced some challenges. Our comments will focus on (I) general issues in the application of the GDPR (II) the international transfer of personal data to third countries; and (III) the cooperation and consistency mechanism between national data protection authorities.
