Response to Sustainable corporate governance

Founded in 1839, Anti-Slavery International is the oldest international human rights organisation in the world. Today, we draw on our experience to work to eliminate all forms of slavery and slavery like practices throughout the world by looking at the root causes of slavery and its consequences to achieve sustainable change. The ILO estimates that 25 million people are in forced labour at any given time, of which 16 million are in the private sector. This includes victims in industries such as construction, textiles, electronics and agriculture, and many other industries besides. Additionally, about 1 in 10 children globally – over 150 million – are victims of child labour, with almost half of them working in hazardous conditions. According to KnowTheChain, over 60% of leading EU-based companies are failing to take adequate steps to address forced labour and almost three-quarters of them fail to provide adequate remedy to victims of forced labour. In a drive for competitive advantage, many European businesses search for reduced costs that are often based on extreme levels of exploitation. Forced and child labour occurs due to a combination of external causes and business model drivers. Many of the root causes of forced and child labour are systemic – linked to poverty, lack of education, discrimination based on caste, descent, race or social constructs, migration status and weak rule of law. Corporate practices and business operations act as a catalyst to the problem and create the demand for forced labour through the constant drive for low prices, quick turnaround for products, the increase of outsourcing, and corporate practices to restrict freedom of association. Anti-Slavery strongly calls for binding human rights and environmental due diligence legislation, with liability and access to justice and remedy that makes companies and investors legally responsible to respect human rights and to identify, cease, prevent, mitigate, monitor and account for potential and actual risks of forced and child labour along their whole value chain, including subsidiaries, suppliers and (sub)contractors. Important elements of this legislation should be: • All business enterprises, no matter their size or corporate structure, must be covered by the legislation; • All business enterprises should promote and ensure freedom of association and collective bargaining as central enabling rights; • Mapping, transparency and traceability of supply chains must be integrated into the due diligence process - up to the lowest tiers of supply chains - where forced and child labour is often the most hidden; • Analysis of the impact of purchasing and outsourcing practices must be integrated into the due diligence process to ensure free recruitment, payment of living wages, compliance with all social rights and ensuring suppliers have the financial capacity to comply with human rights standards; • All concerned stakeholders, including but not limited to workers, workers associations, trade unions, civil society actors, local communities, indigenous groups and any other affected or potentially affected stakeholders, must be consulted and involved at all stages of the definition, implementation and monitoring of the due-diligence process; In this spirit, organisations based in the ‘global south’ should be consulted in the upcoming impact assessment to ensure that the knowledge and perspectives of victims and survivors of slavery and people vulnerable to slavery are central to the design and implementation of the legislation; • The legislation must provide for joint liability for harms caused or contributed to by entities under their control or economically dependent, as well as liability for harms directly linked to their products, services or operations through a business relationship unless they can prove they took all measures to prevent the harm and ensure effective access to remedy for victims, including adequate support mechanisms.
