Response to New comprehensive strategic approach towards India

Ahead of their forthcoming Joint Communication on a new Strategic EU-India Agenda and a jointly agreed five-year Roadmap with India, Amnesty International urges the EU and its member states to ensure that human rights and rule of law commitments are reinforced and placed squarely at the centre of their relations with India. With serious, mounting concerns about human rights and the rule of law in India along with rising authoritarianism, contestation of the international human rights law framework and attacks on the rule of law across the globe - the EU can no longer limit human rights exchanges with India to a human rights dialogue and cooperation at multilateral human rights fora. Instead, the EU and its member states must fully use the opportunity of the forthcoming Joint Communication to set the ambitious groundwork for a concerted mainstreaming of human rights across EU-India relations, in the Roadmap and all the other key next steps in EU-India relations. Even at a time of volatility and vast geopolitical changes, the EU cannot afford to tone down its engagement with India on the rule of law and human rights for short-term political expediency. In the Joint Communication, it will be primordial for the EU and its member states to maintain a wider vision over the next five years and beyond, moving past perceived geopolitical constraints to effectively respond to a rapidly worsening human rights situation in India. As the EU and India deepen their relations, both sides must re-assert how shared values and interests converge around human rights and the rule of law across all areas of relations to achieve a partnership that can truly serve the EU, India and their people. As key global players, the ability of both sides to engage effectively on human rights and the rule of law should be treated as an important measure of the quality of the EU-India partnership. The Joint Communication must envisage opening spaces for dialogue on the rule of law and human rights across all areas of relations from security and defence, trade and technology, to work on climate or at multilateral fora. Both the Joint Communication and the Roadmap must affirm both sides commitment to the rule of law, the universality and indivisibility of rights and the respect and fulfillment of rights to freedom of expression, association and peaceful assembly as enshrined in national and international law. In jointly shaping their partnership, the EU and India must publicly recognize the work of civil society and human rights defenders in their societies and foreground the importance of preserving a safe and enabling environment for their work, in recognition of the contribution they make to the strengthening of societies based on the rule of law. With its increasing role on the global stage, India must rise to the responsibility of respecting, upholding and championing human rights and the rule of law and as Indias partner, the EU must robustly hold the Indian authorities to account to deliver on their stated commitments in practice. Only with the rule of law and human rights at the core of their joint commitments will both sides and the EU-India partnership itself be equipped to confront the challenges of the coming years, at home and in the wider world. Response to European Critical Raw Materials Act

To ensure a just transition, the following changes must be made to the Critical Raw Materials Act (CRMA)*: Certification schemes: The CRMA must remove the reliance on certification schemes to demonstrate Strategic Project compliance with project requirements. These schemes vary significantly in their transparency, requirements and frequency and quality of assessments. Research by Amnesty International and others has shown that membership of such schemes does not indicate that a company has done adequate human rights due diligence, nor does it demonstrate compliance with scheme requirements. For instance, Amnesty International identified severe labour rights abuses on several Indonesian oil palm plantations in 2016 which were certified as producing sustainable palm oil by the Roundtable on Sustainable Palm Oil. Weak sustainability criteria and reliance on Corporate Sustainability Due Diligence Directive (CSDDD): The CRMA states that Strategic Project sustainability will be assessed considering compliance with EU corporate accountability legislation, including the CSDDD, and international business and human rights standards but it is unclear how compliance will be assessed. The reliance on the CSDDD is also problematic as it not yet finalised and Amnesty International has raised concerns that proposed loopholes could weaken the effectiveness of the directive in tackling corporate-related human rights abuses (see Closing the Loopholes; Recommendations for an EU Corporate Sustainability Law which works for rights holders). The CRMA must explicitly state that a project will only be recognized as sustainable if it meets the requirements laid out in international business and human rights standards, including conducting human rights due diligence in relation to all human rights risks and impacts. SMEs: The scope of the CSDDD remains under negotiation but even under the widest proposed scope only companies with >250 employees and 40 million turnover will have to implement the requirements of the directive. Therefore, the CRMA should establish an obligation for project promoters of any size to respect human rights throughout their operations and value chain, and to conduct human rights and environmental due diligence in line with international standards. Consultation: As outlined in international business and human rights standards, consultation with rightsholders and civil society is crucial to identifying the human rights and environmental risks and impacts of Strategic Projects. The CRMA proposal uses very vague language regarding consultation. The CRMA must require safe, meaningful, and ongoing engagement with rightsholders and civil society throughout the lifecycle of a project (including pre-approval) in alignment with international standards. Member states should ensure sufficient resources (including financing and timely, accessible information about the risks/benefits of a project) are available to communities who may be impacted by proposed Strategic Projects. Indigenous peoples: Indigenous peoples have the right to give or withhold their free, prior and informed consent (FPIC) for projects which will impact their rights, territories and resources as derived from their right to self-determination. The CRMA does not require EU member states or project promotors to respect these rights despite the risk that it will increase pressure on the lands of Indigenous peoples in and outside of the EU. The CRMA must require project promoters to respect the rights of Indigenous peoples including their right to be consulted, through their representative institutions, in order to obtain their FPIC for Strategic Projects, ensuring that these communities have the time and opportunity to reach an informed conclusion based on their own forms of decision making. Remedy: Where rights are breached project promotors must provide remedy to those affected in line with their international obligations. *This is a non-exhaustive list

Amnesty International welcomes the Commission’s intention to launch a legislative initiative establishing mandatory rules for corporates not to harm human rights and the environment and to carry out due diligence and to request corporate directors to integrate wider societal and sustainability interests into business decisions. We share the Commission’s assessment that voluntary approaches have proven insufficient to ensure that business enterprises address human rights and environmental risks and adverse impacts in their operations and value chains. Amnesty International also believes that the EU carries a particular responsibility to show leadership in the promotion and protection of human rights and the environment against adverse business-related impacts: its role as the world’s largest economy provides it with significant economic and political power to influence and shape the fair regulation of the global market. Effective, mandatory rules to ensure corporates’ respect for human rights and environment are urgently needed. Amnesty International’s expectations for such a legislation at the EU level are: • An obligation to respect human rights and the environment: The legislation must apply across all sectors to all business enterprises, whether domiciled or otherwise operating within the EU, independent of their form or size. Small and medium enterprises (SMEs) must not be excluded from the scope of the legislation. Instead, Member States should have the competences to adapt due diligence requirements to the special needs of SMEs. The legislation should provide how sectoral regimes may complement this obligation for better protection of human rights and the environment. • Due diligence requirements that ensure that business enterprises effectively and continuously identify, prevent, mitigate, and account for how they address potential and actual human rights and environmental adverse impacts in their global operations, value chains and business relationships, in accordance with international standards. An important element of due diligence is the consultation of and communication with actual and potentially affected stakeholders and rightsholders at all stages of due diligence. The due diligence obligation applies to all business decisions and activities – including the business’ underlying business model, purchasing and investment practices and other strategic decisions. • Access to remedy for those harmed: Where a business enterprise has caused or contributed to human rights or environmental harm, it must provide for or cooperate in the remediation of adverse impacts in their global value chains and within their operations and business relationships. As one instrument of remediation, Member States should ensure civil liability of business enterprises for harm that they, or entities that they control or have the ability to control, including those domiciled in different jurisdictions, have caused or contributed to. The legislation must also address procedural and practical obstacles to access to remedy, including rules on disclosure of evidence and statute of limitations. • A robust enforcement mechanism: The legislation must request Member States to pro-actively ensure compliance of business enterprises with the due diligence requirements and provide competent authorities with effective instruments to do so, including through civil, administrative and criminal liability. Competent authorities should be able to investigate compliance on their own initiative and acting on information by third parties. • Transparency and access to information: Transparency of value chains and access to information for those potentially and actually affected by business activities are essential for a meaningful due diligence process and to ensure accountability. The legislation should therefore entail clear communication, disclosure and reporting requirements for business enterprises.

Response to Modernising the EU’s batteries legislation

As the European Commission (EC) looks to modernize the EU’s batteries legislation, Amnesty International calls on the EC to ensure that human rights and environmental protection go hand-in-hand with the EU’s efforts to transition to green alternatives and address climate change. Amnesty International is encouraged by the EC’s commitment to ensure responsible sourcing and address environmental and human rights risks linked to the battery value chain. Such commitments are crucial given that Amnesty International’s research has shown that businesses across different sectors are failing to carry out basic investigations into the impacts of their operations, products, services and business relations on human rights and the environment throughout their value chains. For instance, our research has shown that a significant portion of the world’s cobalt, a critical mineral for rechargeable battery production, is mined by children and adults in extremely hazardous conditions in the informal mines of the Democratic Republic of the Congo (DRC). Amnesty International traced the cobalt supply chain and found that this cobalt is entering the supply chains of some of the world’s largest electronics and electric vehicle manufacturers, many of which are headquartered or have subsidiaries and offices in Europe. Amnesty International has also found serious concerns around lithium mining in South America.Amnesty International’s investigations have revealed breaches of the rights of Indigenous Peoples to Free, Prior and Informed Consent in relation to lithium mining projects on or near their territories in Argentina. Amnesty International would urge the EC to address the following concerns when reviewing the EU’s batteries legislation: • Mandatory due diligence: As outlined by the United Nations Guiding Principles on Business and Human Rights, businesses have a responsibility to respect human rights. The new law should ensure the enforcement of this responsibility and legally require businesses to carry out due diligence to identify, cease, prevent, mitigate and account for potential and actual human rights and environmental harm. • Addressing risks throughout the entire value chain: Serious risks and abuses can arise at any stage in the value chain, not only when sourcing materials. The law should therefore not only focus on responsible sourcing but on responsible business conduct throughout the entire battery life cycle (that is, from extraction to manufacturing and through to disposal and recycling). • Businesses’ responsibility to engage and cooperate in remedy: The law must enforce businesses’ responsibilities to engage and cooperate in remedy in case harm has occurred. It should establish liability not only for businesses’ own operations, services and products, but also for those business relationships in which they hold control or are able to control, for instance as a parent company. The law should further ensure access to remedy by those who have been harmed, for instance through a reversal of the burden of proof, choice of applicable law and adequate statutes of limitation. • Strengthening supply chain resilience against abuse and environmental harm/reporting: The law should strengthen the resilience of value chains through greater transparency of the chains, including greater transparency of customs information, and require businesses to report on their due diligence processes, their outcomes, how they address human rights and environmental risks and impacts and how they monitor their performance. • Enforcement: Competent member state authorities should have the power to investigate potential due diligence failures on their own initiative as well as on complaints of alleged harmed rights-holders and third parties. The authorities should have adequate instruments available, including sanctions, to ensure compliance by businesses.
