Arkema's position on technical updates to ETS State aid guidelines As a specialty chemicals and advanced materials leader in Europe, we support this revision in view of including additional chemical sectors, as announced in the European Chemicals Industry Action Plan communication of July 8. This will be essential to preserve the competitiveness of Europes energy-intensive industries while supporting their energy transition. Please find attached our position paper.

Response to EU emissions trading system for maritime, aviation and stationary installations, and market stability reserve - review

Arkema recognises the need of a strong carbon price architecture and supports the objective of the ETS directive to unlock decarbonisation investments in a cost-effective manner. We welcome positively the simplification ambition of the European Commission and stress the need to have a flexible and pragmatic climate policy, considering the current technological, economic and geopolitical reality. Furthermore, we strongly support the view that the key to accelerate decarbonisation investments is to unlock critical public support and enable the competitiveness of the European industry, as was brought forward by the Clean Industrial Deal. We share with the Commission our proposal to balance decarbonisation with competitiveness and administratively simplify and improve the EU ETS.

Response to Drinking water - Establishing the procedure for amending the European Positive Lists ('EUPLs')

Arkema welcomes the opportunity to provide written comments to the public consultation regarding the implementation of Article 11 of the Drinking Water Directive (DWD). As a manufacturer and a supplier of substances that can be used in the production of materials coming into contact with drinking water, Arkema will focus its comments on starting substances. We support the overall objectives of DWD. However we would like to express our deep concerns about the proposal, especially regarding inclusion in or removal from the European positive lists. The procedure, as described in the delegated act, will create legal uncertainty for the Dossier submitters that could lost all the benefits of their investments Indeed the constitution of a dossier in initial submissions requires significant investments:both in resources and costs of studies or purchase of letters of access to REACH studies. According to our understanding, the text under discussion could allow any other supplier to use the positive list to put its substance on the European market based on the dossier already submitted by the first submitter without any investements. This is clearly not in favour of innovation. We call the European commission for ensuring that applicants' investments and CBI are fully protected, therefore amending the delegated acts to this effect. The rules and practices implemented for Reach and Biocide regulation must be used as reference (consortia, letter of access, opt-out, joint submission). We strongly require the EU commission to ensure that a positive list is only valid for a referred group of dossiers submitters with established cost-sharing rules. A positive list should not be valid for legal entities that are not members of this group of applicants for one substance/dossier.
