Response to Revision of EU rules on Anti-Money Laundering (new instrument)

ACCIE is delighted to submit feedback on the Commission's proposal for a Regulation on Anti-Money Laundering and Countering Terrorist Financing (AML/CTF). ACCIE welcomes the Commission’s aim to increase the protection of the EU financial system and citizens by setting stricter rules on transfers which are more prone to fraud, as well as by setting higher fraud prevention standards, reflecting the best practices applied by the EU financial market. Response to EU Anti-money laundering supervisor

ACCIE is delighted to submit feedback on the Commission's proposal to eshtablish an European Anti-Money Laundering Authority (AMLA), and would like to highlight that AML supervision must be clearly divided across the different supervisory levels. Response to Consumer Credit Agreement – review of EU rules

The Association of Credit Card Issuers Europe (ACCIE) represents the specialized European credit card issuing industry. ACCIE is happy to submit feedback on the Commission’s proposal on the Revised Consumer Credit Directive (CCD), and wants to draw attention to the following key points regarding the creditworthiness assessment (CWA) and caps on the cost of credit: - The CWA should be proportionate to the level of indebtedness risk a credit product carries. - The CCD should set a bottom limit on caps on the cost of credit, and the Member States should be advised on aspects to be considered when setting the caps. - The CCD should clearly define which costs are included in the caps. Response to Instant Payments

The Association of Credit Card Issuers Europe (ACCIE) is pleased to submit commentary on the roadmap on instant payments, and would like to bring to the Commission’s attention the following points: - Instant payments should be considered complementary to other payment methods, as different payment methods differ in their features, being more favourable to certain payment needs. Thus, consumer choice should be the norm; - The payments market is global in nature, as payments are often made across the national borders and beyond the EU. Thus, for a payment method to answer the market needs it should be interoperable with global payment networks; - A creation of a European payment scheme for instant payments should be designed in collaboration with the European payment service providers (PSPs) involved in other payment methods. Response to Consumer Credit Agreement – review of EU rules

The Association of Credit Card Issuers Europe (ACCIE) represents the specialised European credit card issuing industry. ACCIE is pleased to submit commentary to this consultation, and fully supports the goal of the Consumer Credit Directive (CCD) to ensure high level of consumer protection in consumer credit agreements. Furthermore, ACCIE wants to draw attention to the following key points: • ACCIE is confident that industry initiatives would be the best way to address additional protections for borrowers and lenders during exceptional situations. This is because economic crises are heterogeneous, thus, ‘one size fits all’ approach would not be suitable on guaranteeing adequate protection of the borrowers and lenders interest in exceptional situations. • To ensure borrowers’ protection in credit agreements and a level playfield for all the credit providers, ACCIE recommends to amend the scope of the CCD as to include all new credit providers and types of credit. • ACCIE is confident that the current CCD provides adequate standards for information to be provided to consumers in advertisement and pre-contractual stages. Also, as EBA suggests1, the focus should be on the presentational aspects of this information. • Regarding to creditworthiness assessment, ACCIE recommends to focus on the implementation of the recent EBA guidelines on loan origination and monitoring2 within the scope of the CCD, and investigation of their impacts before determining if legislative action is needed. Response to Review of Regulation on cross-border payments

The Association of Credit Card Issuers in Europe (ACCIE) welcomes the European Commission’s (Commission) legislative proposal to amend Regulation No 924/2009 and enhance transparency in currency conversion. Currently, consumers are often unaware of the different currency conversion options and the costs associated to these. Providing consumers with necessary and reliable information about the different currency conversion options will increase awareness and empowers consumers to make better decisions. Therefore, ACCIE fully supports the efforts of the Commission in this regard. ACCIE believes that a more confined mandate to the European Banking Authority (EBA) is required.
