Response to EMIR Amendment

We set out in the attached document Barclays priority areas of concern on the recent Commission proposals to amend EMIR. In summary, these areas are: 1. Changes to the "financial counterparty" definition, both in relation to securitization SPEs and in relation to closed-end funds. 2. The addition of the small financial counterparty categorization. Whilst we are supportive of the increased proportionality provided for through this addition, we do have some queries on the specific operation of the provisions. 3. The lack of inclusion in the proposals of changes to the risk mitigation RTS in areas where significant issues with the current requirements are already apparent within the market. 4. The practicality of operation of the amended reporting regime whereby the FC takes on the responsibility for reporting of the NFC side of the transaction. 5. The intended practical operation of the FRAND requirement, and its anticipated impact on the market. 6. The need for transitional provisions, due to the changes in particular to the categorization provisions, ie the addition of the small FC category, the increased scope of the FC categorization, and the changes to the mechanics of the NFC determination. 7. The mechanics of the clearing mandate suspension, with respect to which we draw the Commission's attention to the ISDA response on the same issue.
