Borealis would like the Commission to clarify the following points: • Formulation in Annex III regarding term “powder form” • Labelling of solid mixtures: does the 10 µm criteria given for the liquid form also apply to solids? It is not specified in the draft ATP text. • TiO2 is generally not inhaled from plastic waste, however there is a possible plastic waste classification if it contains more than 1% of TiO2 under the EU waste legislation. At Borealis, like in most of the plastics industry, we use a significant amount of TiO2 per year. The vast majority is used as pigment in polyolefin polymer going into automotive, appliances, pipe applications and consumers goods, such as packaging or medical devices. Over the years, we have never observed any correlation between the use of TiO2 in plastics in our operations and health issues of our employees. The vast majority (app. 95 %) of TiO2 used in Borealis is in the form of pelletized masterbatches so the risk of exposure to TiO2 dust in our plants is very limited, hence no special personal safety equipment is necessary, nonetheless ventilation in Borealis plants is in place. Once embedded in the polymer matrix (typically 1 – 2 % TiO2 content) no respiratory exposure is possible any more. There is no commercially available alternative for TiO2 available for the previously mentioned applications. Its intensive colour effects, superior stability towards moisture and UV light play a deciding role to achieve desired properties of our products. The share of applications where TiO2 is used represents more than 4% of Borealis Polyolefin business. Avoiding use of TiO2 would cause loss of turnover and worsen performance of our products. This will in the end have a huge financial impact not only on Borealis, but also on our customers, a lot of whom are SMEs (200 suppliers of products, 75 % SME). In addition, jobs would be lost. The Commission’s proposal will not bring any benefit for human health in our working environment, but will cause only additional testing, approvals and investments in work place safety equipment, all of which will result in higher production and disposal costs: 1. We foresee both an increase of operational costs of consumer goods that consist of coloured plastic parts and a possible reduction of our products portfolio. 2. There is uncertainty and a lot of concern about the impact on our recycling business – concerning usage of post-consumer plastics. 3. Furthermore, as a result of the proposal we anticipate increased regulation for our material where it is used for medical devices or for packaging that comes in contact with food or water.
