Response to Guidance on REDII forest biomass sustainability criteria

UPM welcomes this opportunity to provide comments on the proposed delegated act. UPM is a leading forest industry company with the mission to create products that replace fossil-based materials. To this end, we call for EU policies that recognize and drive further the demand for materials from sustainably produced renewables and limit the use of fossil feedstock. UPM is also leading producer of advanced biofuels in the EU and is currently investing 550 MEUR in to the production of wood-based biochemicals in Germany. Currently we consider further investment in to renewable fuels by conducting basic engineering for a new 500 000 tons/a biorefinery with an estimated investment cost of 1 billion EUR. UPM is frontrunner in working with stakeholders to develop sustainable forestry practices; we have created our own biodiversity programme over 25 years ago and we are committed to leading forestry certification schemes. Sustainability is at the core of all of our operations. For these reasons, EU’s rules on sustainability criteria for solid biomass are of major importance to us. UPM is concerned that the delegated act provides detailed criteria that go" beyond the directive" and that such criteria do not consider the differences in forestry across the member states. When it comes to forestry, one size does not fit all. Wood-based products and sustainable forest management play an important role in the European Green Deal, especially in achieving 2030 climate targets and climate neutrality by 2050. The Commission demonstrated the climate benefits of the forestry sector already in the 2050 vision A Clean Planet for All, where the Commission communicated that products from renewable resources are much needed. The forest industry delivers these products such as construction materials, pulp, packaging materials, textiles, composites, tissue papers, baking and cooking papers, bioplastics, paper and bioenergy. Proposed REDII implementing act under consultation does not bring climate benefits nor stable operating environment for industry. Operational guidance should not go beyond REDII mandate. Instead of guidance, the draft creates substantive forest legislation that should be under Member State competence. Forestry has its own set of legislation at national level taking into account national circumstances. Forestry should not be regulated by EU’s energy legislation. Publicizing the Navigant study would be especially useful for understanding the factual basis of the current proposal. The sustainability criteria should be implemented as agreed in the REDII since for wood processing industry the last 15 years have been time of instability due to unclarity about the sustainability rules. Now with the recently agreed and soon implemented REDII rules, both forest owners and the industry should be given an opportunity to make investments without a risk that rules will suddenly change. Delaying investments is bad news for the climate as it hinders the renewing of the industry. UPM is member of the Finnish Forest Industries Federation and we enclose the more detailed position paper on the specific criteria. We call the European Commission to establish further dialogue to ensure sustainability criteria that benefit forests, the environment, those people working with forests and the climate ambitions of the European Union.

Response to Climate change mitigation and adaptation taxonomy

UPM is committed to EU’s ambitious climate goals. However, UPM considers that the delegated act proposal is counter-productive to achieving EU’s climate targets. UPM supports Commission’s intention to harness also financing sector to fight climate change. However, we see that the delegated act proposal is counter-productive to achieving EU’s climate target. Although UPM has AAA on MSCI ESG rating, AAA on CDP’s Climate/Forestry/Water and leadership position on DJSI’s forestry sector, our activities in the scope would not fulfil taxonomy criteria requirements. The fact that the new criteria can’t be fulfilled even by the most highly rated companies in terms of sustainability, should work as a wake-up call to reconsider the proposal. UPM is a one of the largest forest industry companies in the world with over 10 billion EUR turnover, 18 000 employees and global operations with headquarters in Finland. In addition to our leading position in e.g. paper, pulp, and plywood, and CO2 free energy in the Nordics, we are expanding to new innovations such as advanced biofuels and wood-based biochemicals. Our strategy is to replace fossil-based products with products made from renewable materials. UPM is the only forest industry company in the world recognized as a UN Global Compact LEAD participant for our strong commitment to responsible business. Forestry sustainability criteria should be identical with REDII sustainability criteria UPM is deeply concerned about the proposed criteria for forest management in the proposal. In practice, the criteria would exclude Finnish forest management from the list of sustainable activities. All forest management measures complying with REDII sustainability criteria should be accepted as sustainable activities in the delegated act. The proposed improved forest management, with verification systems via compulsory forest management plans or equivalent with required climate benefit analysis, would heavily increase administrative burden for private forest owners who often are small holders. Discriminative DNSH hydropower requirements must be removed and aligned with existing EU environmental legislation Hydropower is seen in the proposal as an economic activity that qualifies as contributing substantially to climate change mitigation as well as climate change adaptation. However, in contrast to other RES (such as wind, PV and ocean energy), hydropower must comply with general technical screening criteria to prove that lifecycle emissions are below the threshold of 100 gCO2eq/kWh. This does not make any sense as it is scientifically proven that hydropower is among the electricity generation technologies with the lowest life cycle emissions. Hydropower would also have to comply with very strict “do no significant harm” criteria (DNSH) which would in practice exclude e.g. nearly all hydropower in Finland from sustainable economic activities. The DNSH criteria should be deleted. Bioenergy and advanced biofuels are not transitional activities All carbon-free electricity generation technologies must have a level playing-field in the EU. Bioenergy is by far the largest current source of renewable energy in the EU and should not be classified as a “transitional solution”, as proposed now. The same applies to Advanced Biofuels which are key to reducing transport emissions. Nuclear power should be included in the taxonomy as soon as possible. UPM considers nuclear power should also be included in the delegated act. By generating CO2-free electricity, nuclear power contributes significantly to mitigating climate change. Adoption of the delegated act should be postponed so that there is time to consider including also nuclear power in the list of sustainable activities. UPM Response to the draft delegated regulation High and low Indirect Land-Use Change (ILUC) - risk biofuels, bioliquids and biomass fuels The Commission´s Delegated Regulation for High and low Indirect Land-Use Change is tightly scoped around high ILUC risk food/feed crops. As it therefore does not reflect high and low ILUC in general, we see that there is a need to clarify the scope of the high and low ILUC risk biofuels covered in this Delegated regulation versus other ILUC risk schemes. Therefore we propose following amendments: SCOPE OF THE DELEGATED ACT In the Delegated regulation title of the regulation is defined as follows: COMMISSION DELEGATED REGULATION (EU)…/… supplementing Directive (EU) 2018/2001 as regards the determination of high indirect land-use change-risk feedstock for which a significant expansion of the production area into land with high carbon stock is observed and the certification of low indirect landuse change-risk biofuels, bioliquids and biomass fuels UPM recommends following additions to clarify the scope: "supplementing Directive (EU) 2018/2001 as regards the determination of high indirect land-use change-risk food and feed feedstock for which a significant expansion of the production area into land with high carbon stock is observed and the certification of low indirect landuse change-risk food and feed crop based biofuels, bioliquids and biomass fuels" Justification: • The Commission's Delegated regulationfor High and low Indirect Land-Use Change is tightly scoped around high ILUC risk food/feed crops. As it therefore does not reflect high and low ILUC in general, but only covers high ILUC food/feed crops naming of the act should be made more illustrative. For example High and low Indirect Land-Use Change of food/feed crops would be more suitable. RECITALS For further clarifying the role of this Delegated regulation compared to to other low ILUC schemes (other than food or feed as defined by EU REDII), UPM recommends following new recital: New recital xx : "This delegated regulation defines food and feed crop based high and low ILUC risk criteria and certification where ILUC refers only to land use expansion within the same crop. However it is recognized that there may be low ILUC feedstocks other than food or feed as defined by EU REDII. Examples of such feedstocks cover those from intermediate cropping (e.g. Cover crops and catch crops) and other improved agricultural management practices that can sequester carbon. Feedstocks from such schemes do not cause ILUC within the same crop nor do they cause displacement within other crops. These schemes are not covered in this delegated act. "
