The presentation of the Political context, problem definition and subsidiarity check is fair and realistic. BorgWarner fully agrees with the findings made by the commission. The presentation of the political context, the definition of the problem and the subsidiarity check is complete and realistic. BorgWarner fully agrees with the commission's findings. Another objective should also be added concerning an initiative and close collaboration with the countries producing counterfeit products in order to make them aware of the risks for trade and to find other economic models. The EU proposal for rights holder Principles and Best Practices is already in place for the BorgWarner Aftermarket such as the following practices : • appointing a single contact point for IP enforcement; • more actively engaging and participating in tools and systems made available by public authorities and intermediaries to facilitate cooperation and information sharing; • lodging an application for action to request the customs authorities to take action with respect to goods suspected of infringing an IPR and ensuring related follow-up; The following principle of conducting due diligence checks on their business partners in order to increase supply chain transparency is a key element that must be applied by right holders. We are completely in line with this principle and we will support this.
