Základními cíli ČNS IFPI jsou - ve vztahu k České a Slovenské republice: a) prosazovat společné hospodářské a soutěžní zájmy, jakož i zájmy na ochraně práv duševního vlastnictví výrobců zvukových záznamů a hudebních zvukově obrazových záznamů na území České republiky i v zahraničí a spolupracovat při naplňování tohoto cíle s dalšími subjekty. K tomu spolek využívá všechny vhodné postupy, včetně uplatnění nároků soudní cestou, b) usilovat o prosazování práv výrobců plynoucích z platné právní úpravy dle autorského práva a mezinárodních autorskoprávních předpisů, c) osvětovou a edukativní činností napomáhat ke zlepšení právního vědomí veřejnosti v oblasti autorského práva, d) aktivně spolupracovat na mezinárodní úrovni s obdobnými subjekty. Dále mezi hlavní činnosti ČNS IFPI patří: - sledování a podílení se na tvorbě nových legislativních rámců; - vytváření statistik a žebříčků; - atd.

Response to Assessment of the effects of the Recommendation on combating online piracy of sports and other live events

Members of the Czech National Association of the International Federation of Phonographic Industry (CNS IFPI) are record companies / phonogram producers for which CNS IFPI provides service (e.g. dealing with rights related to copyright infringement, statistics, education). The topic of combating online piracy of sports and other live events is important not only in terms of live events but also in terms of any time sensitive content as such. Unfortunately Recommendation on combatting online piracy of sports and other live events did not cover all types of time sensitive copyright and rights related protected content. In terms of music industry time sensitive content means e.g. making available of pre-releases; distribution of unreleased content; unauthorised bootlegs (i.e. the making available of unauthorised recordings of live performances). Generally speaking in the above-mentioned examples is timely enforcement very important and would prevent further commercial harm to the labels and artists. Above mentioned examples should also be part of any further EU recommendations going forward. Proper implementation of the EU acquis at national level is very important e.g. correct implementation of the art. 8(3) of the EU Copyright Directive; correct adaptation of the DSA (e.g. setting up of Digital Service Coordinators, trusted flagger application process); correct implementation of the NIS2 Directive (in particular e.g. correct implementation of the legitimate access seeker provisions). European Commission should continue work on IPR enforcement to provide for effective tools for all right holders to tackle online piracy more effectively including improving the availability of injunctions (expedited, dynamic, catalogue wide, and with cross-border effect), introducing notice and stay down for all host providers, and meaningful responsibilities for all types of online intermediaries to ensure transparency and Know your Business Customer rules so as to remove the cloak of anonymity from criminal operators. Next steps of the European Commission should be focused also on generative AI which evolves rapidly. European Commission should also look at ways to ensure the effective implementation of and compliance with the current EU legal framework related to generative AI. We think that AI Act should be assessed. Meaningful application of the GPAI obligations of the AI Act should be complemented with procedural measures to tackle cases of non-compliance more effectively. In the Czech Republic there are few examples of judicial decisions on blocking of particular cyberlockers´ websites. However such civil law proceedings face the following problems: quite long judicial proceedings in the Czech Republic; large number of Internet Service Providers which should be sued to block the particular websites; such proceeding is quite expensive; in the Czech Republic there is not a possibility of dynamic blocking in the legislation.

Response to Establishment of the scientific panel of independent experts under the AI Act – implementing regulation

IFPI, representing the global recording industry, acknowledges the objectives of the European Commissions proposal to establish a scientific panel of AI experts to assist the Commissions AI Office, other relevant Commission services, and national authorities in implementing the EU AI Act. Our industry recognises AIs potential to complement creativity, while also seeing firsthand the significant risks generative AI poses to copyright-protected content. The AI Act is an important step forward in defining a global model for ethical and responsible AI regulation. If implemented meaningfully, the Act holds the potential to address serious issues with generative AI models that ingest copyright-protected content on a massive scale without authorisation and to encourage partnerships between AI companies and rightholders. Considering this, we strongly recommend that the scientific panel includes experts who have deep expertise in copyright law, as well as a strong understanding of the challenges and opportunities AI technologies present within the cultural and creative ecosystem. Adequate representation from such copyright specialists is essential to ensure that the panel can address complex issues concerning, for example, the unauthorised use of copyright-protected works, voice cloning, and deepfake contentall of which directly impact the livelihoods of artists and rightholders in Europe. We believe that including such experts will enable the scientific panel to better support the European Commission and national authorities in navigating the complexities of AIs impact on cultural and creative industries, safeguarding Europes creative community and fostering innovation within responsible boundaries.
