U.S. Chamber warns EU product liability reform undermines business innovation

Message — The Chamber requests the EU preserve the current balance between consumer and producer rights by limiting expansion of strict liability to intangible products, maintaining existing burden of proof protections, and retaining the 10-year longstop period. They argue the proposed changes create unjustified imbalances favoring claimants through presumptions, extended liability chains, and reduced evidentiary standards that will deter innovation.123
Why — This would shield U.S. manufacturers from expanded liability exposure and reduced evidentiary protections that increase litigation risk and compliance costs.456
Impact — European consumers lose stronger protections for psychological harm, data loss, and damage from AI systems and software defects.7

U.S. Chamber of Commerce Warns EU AI Liability Rules Risk Stifling Innovation

They argue the proposal should preserve basic burden of proof protections and establish clearer standards for when presumptions apply.12

U.S. Chamber of Commerce urges flexible, risk-based AI rules

They propose limiting regulator access to sensitive trade secrets like source code and data sets. Additionally, they advocate for international alignment to ensure transatlantic regulatory interoperability.123
Why — This approach would reduce significant compliance costs and protect proprietary technology from disclosure.45
Impact — Public authorities and consumer groups may lose the ability to independently verify algorithms for bias.6

US Chamber warns EU against weakening drug patent protections

Message — The Chamber asks the EU to maintain strong intellectual property rights and avoid cutting investment incentives. They also oppose rules forcing companies to launch products in all member states and suggest faster reimbursement.12
Why — Maintaining current incentives protects the global competitiveness and investment returns of US biotech firms.3
Impact — European healthcare systems and consumers could face higher costs if supply chains are forced local.4

Response to Intellectual Property Action Plan

This submission complements the U.S. Chamber of Commerce's ("Chamber") support for the EC’s leadership to promote and protect IP in the EU and internationally. The world’s capacity to innovate, underpinned by increasingly sophisticated property rights in knowledge assets, is unrivaled in history. Moreover, it is clear that the pandemic and its economic challenges will only be overcome through government and business partnerships that respect IP. To accelerate economic recovery, the Chamber believes EU policies must foster an ecosystem for innovation and creativity. This must build on a stable IP system, with incentives to attract capital, enable investment, and create high-value jobs. Chamber research finds strong correlations between a country’s IP regime and its performance on key socio-economic indicators. Robust IP protections are a key driver of investment, enable financing and R&D, provide predictability and security for collaboration and licensing, and accelerate the launch of new technologies, medicines, and cultural products. We highlight the risk of eroding or tampering with successful, existing EU incentives e.g. EU orphan and pediatrics regulations have generated innovations that improve patient health. Backsliding on IPR would diminish EU competitiveness, while targeted initiatives would promote greater IPR use by SMEs (see below). The Chamber specifically recommends: 1. Upgrading IPR Protections & Promoting their Use We welcome the EC’s support for a Unitary Patent (UP) system and a unitary Supplementary Protection Certificate (SPC) to address fragmentation. A functioning UP system will provide clarity that increases the EU’s attractiveness to investors. The biopharmaceutical sector, with its high failure rate in drug discovery, large R&D costs, and lengthy approval processes, is reliant on IPR’s temporary protections. Technologies and methods relating to biotech in particular hold great promise, and IP is essential for their development. These innovators rely on protection and enforcement of patents, regulatory test data, safeguards against unfair commercial use, as a basis for long-term, high-risk, capital-intensive investments. The EC should promote SPCs and implement the SPC export waiver in a way that avoids reduced innovation. To promote the uptake of IPRs, the EU should encourage public-private cooperation, to ensure academic discoveries become innovations that are available to consumers. The Bayh-Dole Act in the U.S. provides a useful model . 2. Strengthening IPR Enforcement We support the EC’s efforts to raise awareness of the harms piracy and counterfeits inflict on businesses and consumers, and we encourage meaningful actions to prevent IP violations in global supply chains. 3. Adapting the EU IP framework & the Digital Ecosystem COVID-19 has accelerated digital transformation, enabling consumers and companies to operate in an increasingly interconnected way. We support the spirit of the phrase “what is illegal offline should be illegal online,” and looks forward to working with the EC on the forthcoming Digital Services Act to maintain and strengthen IPR protections. 4. Champion Global Fair Play: The EU IP regime is a significant—if underappreciated—comparative advantage, and it should be protected. The EU should be commended for leading through: international promotion of IP rights, capacity building, trade agreements, multilateral organizations, and bilateral forums such as the Transatlantic IPR Working Group. We encourage the EU to bolster efforts to negotiate comprehensive trade agreements to promote strong IPR protections and ensure other governments enforce IPRs, consistent with international commitments.

Response to Report on the application of the General Data Protection Regulation

The U.S. Chamber of Commerce welcomes the opportunity to provide the European Commission with comments on the implementation of the General Data Protection Regulation. The U.S. Chamber of Commerce (“Chamber”) is the world’s largest business federation, representing the interests of more than three million enterprises of all sizes and sectors. The Chamber is a longtime advocate for stronger commercial ties between the United States and the European Union. According to a recent Chamber study jointly commissioned with AmCham EU, the U.S. and EU are jointly responsible for over one-third of global gross domestic product, and transatlantic trade and investment supports 16 million jobs on both sides of the Atlantic. The Chamber is also a leading business voice on digital economy policy, including on issues of data privacy, cybersecurity, digital trade, artificial intelligence, and e-commerce. In the U.S. and globally, we support sound policy frameworks that promote data protection, support economic growth, and foster innovation. Since its enactment, the General Data Protection Regulation has reshaped how U.S. firms do business in or trade with the European Single Market. While the Regulation is proving beneficial in some respects, the past two years offer a wealth of information on how its implementation may be improved. First, the Chamber recommends that the European Commission reinforce and broaden GDPR’s international data transfer regime, as persistent legal uncertainty is undermining these core elements of the Regulation. Second, closer cooperation between data protection authorities is needed to ensure consistent interpretation and efficient enforcement of GDPR across the single market. This includes strengthening and reinforcing the one-stop-shop mechanism. Addressing these concerns will enable the Commission to improve both data protection and the EU’s economic competitiveness, including in the development and use of data-driven technologies such as artificial intelligence. The current COVID-19 pandemic highlights the importance of a practical approach to data protection. As policymakers and the business community prepare for economic recovery, regulatory pragmatism will continue to be necessary. Businesses are likely to suffer limited organizational capacity and significantly reduced financial resources for the foreseeable future. DPAs may need to issue new or revised guidance and provide regulatory forbearance, as businesses struggle to remain viable. We encourage the Commission to integrate the lessons learned in the current crisis, along with the experiences of the past two years, into how GDPR is implemented in practice. The Chamber has outlined its recommendations in the attached document.
