Response to Review of the de minimis aid Regulation

Il Regolamento de minimis attualmente in vigore (Reg. UE n. 1407/2013) prevede che – a determinate condizioni – gli aiuti che su un periodo di tre anni non superano la soglia di 200mila euro per “impresa unica” non siano considerati aiuti di Stato, e siano pertanto dispensati dalla procedura di notifica e preventiva approvazione comunitaria. L’assunto alla base di questa struttura è che il citato importo sia talmente esiguo da non alterare la concorrenza tra gli Stati membri e non incida sugli scambi. In via preliminare, si ribadisce che un’opportunità di questa natura vada assolutamente mantenuta nella disciplina comunitaria sugli aiuti di Stato ma, allo stesso tempo, si debba attivare un sistema di monitoraggio tale per cui sia possibile verificarne l’utilizzo da parte degli Stati membri. Response to Unitary Supplementary Protection Certificates (SPC) – creation and granting procedure

A centralized system for the grant and enforcement of a Unitary SPC (“uSPC”) through a single procedure, analogously with what is being achieved with the European Patent with Unitary Effect and Unified Patent Court ( EP-UE and UPC, respectively) is certainly a very desirable option with a view to creating a more predictable, less burdensome and cost-effective system for Europe. Conveniently, the path to be followed should be the one devised for European Patent with Unitary Effect and UPC. In particular, uSPC can be created as a new property title via an EU Regulation, analogous to Regulation EU 1257/2012; its grant, via a centralized procedure, can be entrusted with the European Patent Office (EPO; as currently envisaged for European Patent with Unitary Effect) and its enforcement, to the UPC. In addition to the advantages of centralized procedures, following the path already devised for the European Patent with Unitary Effect (EP-UE), will also have the advantage of expanding the scope of cooperation tools already devised, e.g., the ones in place with the EPO for granting EP-UE, and counting on the expertise of the EPO in granting patents in all fields of technology, pharma included, of course. As pointed out, the UPC is already competent for currently available “national”SPCs, so it would be just consequent to have jurisdiction also over the new “unitary” SPCs. Additionally, the primacy of EU Law, it is already foreseen and embedded into the UPC Agreement and its procedures, so that nothing more should be required in this respect. Regarding the possible concerns due to the fact that EPO is not a “EU” Institution strictu senso, in addition to the fact that the problem has been already considered and solved positively as mentioned above, when entrusting the EPO with the grant of EP-EU (or “unitary” European Patents), the following should be taken into account. There is an evident advantage in organizational costs if the same authority that is going to grant “uEP” will grant also “uSPC”, that will be based either on uEP or “classic” EP, that are in any case granted by the EPO as well. Competence of Examining Divisions in professionally examining and granting a European "patent" titles should be considered a plus too, in this context. Same for the background in examining substantive aspects of patentability in the tech field of SPCs as well. Moreover, being a European institution working daily in European multinational teams according to given tasks and guidelines, can be expected to be a key element in really facilitating a harmonized workflow also in the case of uSPC exam. The framework of cooperation and work organization already in place for unitaryEP may to the very least used as a model for performing the tasks under the new uSPC. A key element could be a set of Guidelines for granting uSPC, to be built as usual with a dialogue with users and possibly characterized by key cooperation and common "drafting" and ultimate revision with/endorsement by EU Commission competent services. These "guidelines" (to be developed/updated as necessary to follow the evolution e.g of the EUCJ jurisprudence) should be enough to assure the proper framework for the decisions on granting/refusing a uSPC application. Notably, following the uEP model law, one should always keep in mind that these decisions of the EPO will be open to appeal at the UPC (two levels of judgment) that according to Regulation EU 542/2014 is to be considered as a Court of a EU member state as to compliance with EU Law and power/duty of asking preliminary rulings at EUCJ, in full compliance with EU law and its primacy.

Response to Revision of EU rules on Gas

Confindustria welcomes the revision of Directive 2009/73 and Regulation 715/2009, considering that the future H2 framework can be embedded within the principles of the Gas Internal Energy Market. Gas is an enabler of the EU decarbonization: several sectors rely on natural gas to fuel industrial processes (directly or through cogeneration) or as input for chemical production. Moreover, in many EU countries power generation from natural gas is going to be the main technology replacing coal and granting flexibility for NPRES in the medium term. Finally, gaseous fuels can contribute to the transport sector low carbon transition, especially in maritime, heavy duty and aviation sections. Therefore, an integrated gas system, including LNG, plays a crucial role for European Supply, energy diversification and market competitiveness. There is still to be done to achieve the Gas Target Model objectives and spreads among markets are still critical between North-West Europe and the Italian hub because of transportation tariffs along gas routes (pancaking effect). Different solutions could be effective to obtain a single gas market, e.g. the merge of national entry/exit zones applicating tariffs on external borders and on demand. It can also prevent the risk of decommissioning for those pipelines currently facing low demand but necessary for market competition and future H2 repurpose. Nevertheless, provisions aimed to enhance competitiveness should be fully applied and the 15-year time limit for LT capacity should be voluntarily applicable to existing contracts deriving from past allocation procedures. The deployment of low/zero carbon gaseous fuels will provide a contribution in lowering the GHG emissions if adequate amounts of commodity, interoperable grids, secure storage equipment and reliable end-use technologies would be available at competitive prices to fulfill energy consumption of hard to abate sectors, in synergy with electrification trends. To reach the Green Deal objectives it is important to create a coherent legislative framework, combining all EU Regulations, so to define policies and market-based mechanisms to facilitate new gasses demand, vectoring, generation and value chain equipment production (It’s for example crucial the reduction of administrative barriers). A fair competition among technologies (P2X, storage, CCS/U, ..) and vectors shall be promoted, through the institution of an EU classification / certification, based on life cycle GHG emission savings, and a level playing field for all flexibility and market resources. It is important to pursue a gradual, flexible, open and technology neutral approach: the early development of alternative gasses shall avoid distortions of the NG markets and tariffs and be coordinated with the effective starting point/production possibilities of the different UE Countries. A regulatory sandbox approach would be beneficial to encourage R&D projects and subsidies should be considered to ease the decarbonization of those sectors where electrification is not technically or economically feasible besides where a H2 use/infrastructure already is present. In view of a growing electricity-gas sectors coupling and market integration, the key principles of the energy regulation (Unbundling, TPA, ..) and cost-benefit evaluations of the infrastructure planning shall be synergically considered. The EU legislation should recognize the possibility for TSOs/DSOs to own, develop and operate H2 networks, as well as, to test H2 injection into their grids, so to verify standards (safety, quality, measurement) and promote the efficient use and retrofitting/repurposing of existing infrastructures, avoiding stranded costs. It’s important to ensure a transparent, fair and non-discriminatory access to the infrastructure to the decentralized production of renewable and low carbon gases and hydrogen and a correct allocation of costs avoiding cross subsidies between regulated and market-based activities.

ABSTRACT - Gli oneri amministrativi dovrebbero essere ridotti e il processo decisionale dovrebbe essere accelerato. Il punto 17 e 29 degli Orientamenti in vigore dovrebbero essere eliminati. - Le procedure necessarie per attivare lo strumento dovrebbero essere semplificate. Sebbene la Commissione preveda di mantenere il controllo su tutti i finanziamenti individuali degli Stati membri partecipanti al progetto europeo comune (poiché tale finanziamento è ammesso in misura maggiore dei limiti ordinari degli aiuti di Stato), dovrebbe essere richiesta un'unica procedura di notifica, quindi tutti i successivi finanziamenti pubblici dovrebbero essere considerati automaticamente ammissibili una volta approvato il Progetto Comune nel suo insieme. - È fondamentale abbreviare i tempi delle procedure di approvazione, rendendole più veloci, soprattutto in settori in cui i cicli di innovazione sono molto brevi. - È possibile che l'IPCEI sia supportato non solo attraverso risorse nazionali, ma anche attraverso finanziamenti da istituzioni europee (Commissione, BEI, ecc.), gestiti direttamente (come, ad esempio, quelli di Orizzonte Europa) e indirettamente (come quelli dei fondi strutturali). Come indicato nella comunicazione sull'IPCEI (sezione 3.2.2, lettera f), la Commissione adotta un approccio più favorevole in questi casi, ma è necessario favorire la combinazione dei vari tipi di finanziamento disponibili attraverso un maggiore allineamento di regole e procedure. - È cruciale riservare una posizione delle PMI al centro delle catene del valore europee strategiche, prevedendo una semplificazione delle regole ed esonerandole da altri oneri informativi. - È fondamentale dettagliare meglio le definizioni (in particolare “first industrial deployment”) e riconoscere OPEX e CAPEX relative per andare sul mercato e realizzare le corrispondenti prime vendite sul mercato derivanti dalle attività FID per sostenere la competitività. - È auspicabile, ammettere il modello del “Capex full cost” invece del “Depreciation only”. Confindustria ha apprezzato e ritenuto condivisibili i principi contenuti nel “Piano d’azione per finanziare la crescita sostenibile”. Inoltre, ha condiviso la scelta di elaborare una tassonomia che servisse da riferimento comune in Europa. Tuttavia, va evitato che la tassonomia possa trasformarsi in uno strumento troppo complesso per imprese e partecipanti al mercato finanziario e che introduca oneri di adempimento tali da scoraggiare, piuttosto che favorire, lo sviluppo di prodotti finanziari correlati agli obiettivi green.Non è stata pertanto ritenuta condivisibile l’introduzione nel Regolamento Tassonomia della previsione che estende l’ambito di applicazione anche a tutte le imprese soggette alla disciplina europea sulle Dichiarazioni non finanziarie. Tale previsione rischia, infatti, di penalizzare in particolar modo le imprese presenti sui mercati dei capitali qualora queste non siano già in linea con gli obiettivi fissati dalla tassonomia. Prendendo atto dell’attuale normativa, Confindustria ritiene che l'iniziativa della Commissione di specificare regole e metodologie per le imprese soggette alla NFRD per divulgare informazioni su come le proprie attività siano qualificabili come sostenibili ai sensi della tassonomia dell'UE, debba tenere conto delle seguenti considerazioni. In questi ultimi mesi sono intervenuti fattori di contesto imprevedibili ed eccezionali che renderebbero opportuna una riconsiderazione delle tempistiche previste per l’attuazione e l’applicazione delle disposizioni previste dal Regolamento Tassonomia per le imprese già soggette alla NFRD. Infatti, tali obblighi comporteranno maggiori oneri connessi alla revisione dei processi di rendicontazione e i relativi cambiamenti nella raccolta, elaborazione e certificazione dei dati. Costi esterni e interni che, in questo difficile momento per l’economia mondiale dovuto alle problematiche conseguenti alla pandemia Covid-19, potrebbero sovraccaricare le imprese, in buona parte già in affanno e in straordinaria carenza di liquidità. La tempistica definita per l’emanazione e l’applicazione dell’atto delegato appare troppo stringente e sarà estremamente difficile per le imprese rispettare l’obbligo di rendicontare le informazioni relative all’esercizio finanziario 2021 nel corso del 2022. Si ritiene opportuna una riprogrammazione dei tempi previsti, nonché mantenere il principio di uno o due anni pilota.Altresì si rende necessaria una valutazione d’impatto dell'atto delegato prima della sua applicazione affinché i requisiti di rendicontazione aggiuntivi rimangano in equilibrio con il valore effettivo delle informazioni generate per le parti interessate tenendo conto: della competitività internazionale delle industrie dell'UE e dell'economia dell'UE in tutti i loro aspetti;del rischio potenziale di dislocazione di attività non ammissibili alla tassonomia in Paesi con ambizioni climatiche inferiori;degli sforzi delle aziende che sono in transizione e che stanno trasformando i loro modelli di business per essere parte della soluzione. Dovrebbe essere inoltre valutato che, in questi mesi, le imprese sono state sottoposte a una forte pressione finanziaria e hanno dovuto fare uno straordinario ricorso all’indebitamento bancario per poter gestire la carenza di liquidità determinata dall’emergenza Covid-19, rendendo ora assai complicato accedere ai finanziamenti per compiere gli investimenti utili ad accelerare la transizione verso gli obiettivi di sostenibilità. In sintesi si ritiene opportuno che l’atto delegato: contenga chiare istruzioni e linee guida al fine di avere specifiche informazioni / esempi sui KPI e sui relativi metodi di calcolo per condurre efficienti cambiamenti nel sistema contabile interno da cui le informazioni dovrebbero derivare; mantenga la flessibilità nella rendicontazione che deve tenere conto delle caratteristiche dei diversi settori, modelli di business e delle pratiche e attività specifiche delle imprese.

Nell’ambito delle consultazioni pubbliche relative alle proposte di Regolamenti delegati a integrazione del Regolamento (UE) n. 2016/1011 e alle comunicazioni relative alla sostenibilità finanziaria, si intende portare all’attenzione della Commissione europea alcune considerazioni. Confindustria condivide gli obiettivi generali della proposta di Regolamento e dei suoi atti delegati, volti ad orientare i flussi finanziari verso uno sviluppo a basse emissioni di gas a effetto serra. Infatti, gli indici di riferimento sono di fondamentale importanza per i portafogli e i prodotti d’investimento e la loro qualità incide sulla valutazione della loro performance. In una fase delicata di rilancio delle attività economiche e degli investimenti, soprattutto in occasione della recente crisi, è importante che la trasposizione degli indici di riferimento per il clima e dei fattori ESG (ambientali, sociali e di governance) nelle metodologie sottese agli indici di riferimento fornisca la chiarezza necessaria a tutti gli operatori economici e industriali.

Nell’ambito delle consultazioni pubbliche relative alle proposte di Regolamenti delegati a integrazione del Regolamento (UE) n. 2016/1011 e alle comunicazioni relative alla sostenibilità finanziaria, si intende portare all’attenzione della Commissione europea alcune considerazioni. Confindustria condivide gli obiettivi generali della proposta di Regolamento e dei suoi atti delegati, volti ad orientare i flussi finanziari verso uno sviluppo a basse emissioni di gas a effetto serra. Infatti, gli indici di riferimento sono di fondamentale importanza per i portafogli e i prodotti d’investimento e la loro qualità incide sulla valutazione della loro performance. In una fase delicata di rilancio delle attività economiche e degli investimenti, soprattutto in occasione della recente crisi, è importante che la trasposizione degli indici di riferimento per il clima e dei fattori ESG (ambientali, sociali e di governance) nelle metodologie sottese agli indici di riferimento fornisca la chiarezza necessaria a tutti gli operatori economici e industriali.

Confindustria urges science-based targets for Farm to Fork strategy

Response to Fast-track interservice consultation on the 'SEIP including a JTM and the JTF"

Confindustria condivide gli obiettivi generali perseguiti dalla proposta di Regolamento che istituisce il “Fondo per una transizione giusta”, tuttavia essa presenta diverse criticità. Innanzitutto, le risorse destinate allo scopo sono insufficienti. La proposta della Commissione prevede per il Fondo una dotazione finanziaria di 7,5 miliardi di euro, stanziati nell’ambito del bilancio pluriennale dell’UE nel periodo 2021-2027, tuttora in discussione. A queste risorse si prevede di aggiungere una quota proveniente dal FESR e dal FSE+ da parte degli Stati membri (con una proporzione tra 1,5 e 3,0 euro per ogni euro del JTF), nonché ulteriori contributi nazionali. Nel complesso, i finanziamenti a disposizione del Fondo dovrebbero essere compresi tra i 30 e i 50 miliardi di euro nel periodo 2021-2027. La proposta della Commissione sarà, tuttavia, trattata nell’ambito dei negoziati sul Quadro Finanziario Pluriennale (QFP), attualmente in discussione in sede di Consiglio europeo. L’ultima proposta sul QFP, presentata dal Presidente del Consiglio europeo Charles Michel, prevede la riduzione delle risorse stanziate negli altri programmi settoriali per consentire la creazione del JTF senza ulteriori spese da parte degli Stati membri. Se i negoziati dovessero proseguire nella direzione indicata, il valore complessivo del bilancio 2021-2027 potrebbe essere addirittura inferiore rispetto alla proposta iniziale dalla Commissione, che infatti nel 2018 non includeva il JTF, a scapito di altre rubriche, tra cui i fondi per la ricerca e gli investimenti (InvestEU e HorizonEurope) e, in particolare, le politiche strutturali (Coesione e PAC). In questo contesto, il profilo del legame con i fondi di Coesione, per un paese come l’Italia, è molto delicato. Le risorse per il JTF, al netto di quelle che la Commissione definisce come “nuove”, ma che in realtà sono già frutto di tagli alla proposta di bilancio del 2018 della Commissione, verranno in larga parte da un trasferimento di risorse dal FESR e dal FSE+ (cfr. proposta di emendamenti al regolamento CPR, art. 21-bis), andando così a definire un generale quadro di impoverimento della politica di Coesione, già peraltro ridotta dalla proposta del QFP, rispetto al periodo di programmazione 2014-2020. Il rapporto con la politica di Coesione va, inoltre, analizzato non solo in relazione agli aspetti legati alla dotazione finanziaria, ma anche con riferimento agli obiettivi stessi del JTF. Se, infatti, il JTF si propone di contribuire ad affrontare le sfide “sociali, economiche ed ambientali della transizione verso un’economia verde”, allo stesso scopo sembrano tuttavia concorrere i fondi SIE (FESR, FSE+ e Fondo Coesione): l’Obiettivo strategico 2, infatti, (art. 4, proposta di CPR) prevede il sostegno a investimenti per la promozione di un’Europa più verde e a basse emissioni di carbonio, e tutti i Fondi strutturali dovranno già contribuire a questo obiettivo per una quota tra il 25% e il 35% del totale delle risorse (percentuale ancora da confermare in sede di negoziato). Sotto il profilo economico e ambientale tale sostegno viene assicurato dal FESR, mentre sotto il profilo sociale il regolamento FSE+ prevede azioni di supporto allo sviluppo di competenze e al miglioramento dei sistemi di istruzione e formazione nei processi della transizione industriale e per la creazione di nuovi posti di lavoro in settori collegati all’ambiente, al clima e all’energia e alla bio-economia. Anche gli obiettivi specifici dei Fondi sembrano sovrapporsi: l’art. 4 della proposta di regolamento JTF, che li elenca, cita attività già sostenute dal FESR, dal Fondo di Coesione e dal FSE+, con la sola eccezione degli investimenti per la rigenerazione e decontaminazione del territorio, peraltro sostenuti con il programma LIFE e con il FEASR. La creazione di un ulteriore Fondo, che riprenda gli obiettivi dei fondi esistenti, rischia di generare confusione amministrativa e procedurale.
