Response to Commission Regulation setting maximum residue levels for chlorate in or on certain products

Der deutsche Fruchthandelsverband e.V. (DFHV) vertritt als nationale Spitzenorganisation der Branche die Interessen von Unternehmen aus allen Handelsbereichen des Obst- und Gemüsesektors. Der Verband repräsentiert die Unternehmen der Direktvermarktung, des Imports und Exports, sowie des Groß- und Einzelhandels. Der weitaus überwiegende Teil aller Umsätze bei frischen Obst und Gemüse in Deutschland entfällt auf die DFHV-Mitgliedsunternehmen. Die öffentliche Kennnummer des DFHV im Transparenzregister ist die 516063829302-96. Als Vertreter des deutschen Fruchthandels möchten wir gerne zum Vorhaben „Festsetzung von Rückstandshöchstgehalten für Chlorat in Lebensmitteln in der Verordnung (EG) Nr. 396/2005“ mit dem im Anhang beigefügten Dokument Stellung nehmen.

Response to Amendment of the import and internal movement requirements of harmful organisms of plants

We are a non-profit association established under the German legislation and registered at the district court of Bonn in the register of associations (VR 8790) . The DFHV is registered in the EU transparency register under number 516063829302-96. We appreciate the possibility to comment on the draft Commission Implementing Directive (SANTE/10711/2018) amending Annexes I to V to Council Directive 2000/29/EC and would like to refer to our comments in the attached file.

Response to Listing high risk plants & plants for which a phytosanitary certificate is not required for introduction into the Union

The Deutsche Fruchthandelsverband (DFHV) is the German fruit trade association and represents the German trading companies, such as importers, exporters, wholesale traders, producer cooperatives and retailers, for fresh fruits and vegetables. The DFHV is registered in the EU transparency register under number 516063829302-96. We appreciate the possibility to comment on the draft Commission Implementing Regulation establishing a provisional list of high risk plants, plant products within the meaning of Art. 42 of Regulation (EU) 2016/2031 and a list of plants for which phytosanitary certificates are not required for introduction into the Union, within the meaning of Art. 73 of that Regulation (SANTE/10766/2018). We are following the European plant health legislation very closely as it has a very big impact on our sector. In our view, it is very important to protect the European production from foreign pests and diseases. We therefore support all measures that are necessary to ensure a high level of protection. Nevertheless it is also very important to consider the impact on trade. Therefore all measures under the plant health legislation should be scientifically and technically appropriate to prevent the entry of pests and diseases in the EU, proportionate in a risk and impact assessment and should have the least possible impact on trade. Under this understanding of an effective and proportionate plant health regime, we support the draft regarding the list of high risk plants in terms of Art. 42 of Regulation (EU) 2016/2031, listing mostly plants for planting. Compared to plants for planting and seeds, fresh fruit and vegetables offer a low risk for transmission of pests and diseases. Even if some fruit might be a carrier of pests and diseases, it is very unlikely, that those pests or diseases will be transmitted to the European production. To deal with those comparably low risk there are other restrictions under the plant health legislation possible than a total import ban according to Art. 42. Those restrictions are already effective und the Directive 2000/29 and have proven to be sufficient. An import ban, on the other hand, would lead to an disproportionate impact on trade and would have an effect on the availability of some fruits and vegetables on the European market. This foresaid we want to state that we fully support and endorse the response of our European parent organization, Freshfel Europe (13th of August 2018).
