Response to COMMISSION DELEGATED REGULATION on extending the scope of traceability of the Union database

In general Envien Group welcomes and supports introduction of the Union Database for biofuels (UDB) as a tool to bring more transparency and traceability to the EU biofuels markets and to increase fraud prevention. However, we would like to emphasize that we are strongly concerned with the whole UDB initiation phase due to lack of clear communication, unsufficient coordination and constantly changing statements provided either from Commission UDB team or from voluntary schemes. Right now we do not consider UDB to be 100% prepared for use. There is a lot of uncertainty about potential risks of not being fully compliant with UDB from 21.11.2024. The draft Delegated Regulation (DR) itself has been much-anticipated, however, we must emphasize that its timeline is significantly delayed, given the approaching deadline for the UDB to be fully operational. Taking into account the time required to finalize the DR and the mandatory 2-month scrutiny period, we expect that the DR will come into effect several months after legally binding deadline of 21.11.2024. This situation even further promotes uncertainties about legal grounds for enforcing EOs to be fully compliant with the UDB requirements. We call out to the Commission to introduce transitional period during year 2025 as already requested by industry stakeholders and the majority of Member State. This situation, coupled with the unsatisfactory current status of UDB implementation for full operational requirements by EOs, could have a substantial negative impact on the industry if no action is taken.

Response to Greenhouse gas emissions savings methodology for low-carbon fuels

Spoločnosť Envien Group si uplatňuje k navrhovanému delegovanému aktu nasledujúce pripomienky: 1. Počítanie emisií z pevných vstupov (rigid inputs). Na základe návrhu delegovaného nariadenia predstavujú emisie z pevných vstupov (rigid inputs) emisie vyplývajúce z presmerovania týchto vstupov od predchádzajúceho alebo alternatívneho použitia. Tieto emisie zohľadňujú stratu výroby elektriny, tepla alebo produktov, ktoré boli predtým vyrobené použitím vstupu, ako aj akékoľvek emisie spôsobené dodatočným spracovaním vstupu a dopravy. Konkrétne v prípade straty výroby elektriny v dôsledku jej presmerovania sa zvažujú emisné faktory pre výrobu elektriny zo siete v krajine, kde došlo k presmerovaniu. Uvedená definícia je pomerne nejasná a vytvára priestor pre pochybnosti čo je možné chápať a ako počítať pevný vstup. Otázne je najmä započítanie elektriny, ktorá bola presmerovaná za účelom výroby LC palív a príslušné emisné faktory pre výrobu elektriny zo siete v krajine, kde došlo k presmerovaniu. V prípade presmerovania LC elektriny (vyrobenej z jadra) je následná chýbajúca časť počítaná ako emisný priemer národného mixu, alebo sa pripočíta emisná intenzita nového zdroja nahrádzajúceho presmerovanú LC elektrinu? Čo v prípade prebytkov vyrobenej LC elektriny, ktoré nie je potrebné nahrádzať novým zdrojom? Záver: Dôvod, prečo sa elektrina (alebo materiál použitý na výrobu tejto elektriny) odvádza na výrobu LC paliva, je ten, že má nízky obsah uhlíka, čo má za následok zníženie emisií skleníkových plynov v sieti. Presmerovanie LC elektriny zo siete a pridelenie emisného faktora založeného na výrobe elektriny zo siete v krajine, v ktorej došlo k premiestneniu, preto vytvorí vyššie nepriame emisie, s čím v navrhovanom nariadení nesúhlasíme. 2. Využitie elektrinu z OZE na výrobu LC palív? Smernica EP a Rady (EÚ) 2024/1788 o spoločných pravidlách pre vnútorné trhy s obnoviteľným plynom, so zemným plynom a s vodíkom neumožňuje, aby pochádzal LC vodík z OZE. V texte nariadenia sa však spomína využitie OZE elektriny pri výrobe LC paliva. Text je v otázke OZE elektriny a jej využitia z nášho pohľadu nejednoznačný. Záver: Považujeme za potrebné vyjasniť, či je možné na základe textu návrhu nariadenia využiť OZE elektrinu na výrobu LC palív? 3. Riešenie situácie, keď bude zachytený uhlík následne unikať Návrh DR podporuje koncepciu bezpečného a trvalého skladovania uhlíka, avšak v súčasnosti nie je jasné, čo sa stane, ak zachytený a uložený uhlík začne unikať. Záver: Považujeme za potrebné vyjasniť, čo v prípade, že uhlík následne unikne po tom, čo bol uložený uhlík pripísaný k LC palivu. 4. Potreba vyjasnenia spôsobu počítania emisnej stopy pri primiešanom LC palive V prílohe A bode 1 návrhu DR sa uvádza, že Ak je palivo zmesou palív s nízkym obsahom uhlíka a iných palív, všetky druhy palív sa považujú za palivá s rovnakou intenzitou emisií. Záver: Navrhujeme, aby bol návrh v tejto veci konkrétnejší. Je potrebné vyjasniť, ako bude toto pravidlo fungovať, ak sa LC palivo zmieša s fosílnym palivom. Znamenalo by to automaticky stratu výhody zníženia emisií prostredníctvom primiešaného LC paliva?

Response to 2040 Climate Target Plan

Envien Group welcomes the opportunity to contribute to the European´s Commission public consultation on the EU´s intermediary climate target for 2040. The intermediary target cannot be achieved without decarbonising European transport sector, which is still overwhelmingly reliant on fossil fuels and unlike in other sectors greenhouse gas emissions from transport continue to grow. Transport is a complex sector, which produces around 25% of overall greenhouse gas emissions in Europe and requires a support of all available and effective instruments and technologies in order to cut down the emissions from transport to net zero in 2050. In this context, sustainable carbon neutral fuels such as renewable biofuels will have to keep playing crucial role in the transition to a carbonneutral future. We invite EU policymakers to take into consideration attached position paper when setting up 2040 targets.

Response to Update of list of sustainable biofuel feedstocks

Envien Group welcomes the step of European Commission to finally launch public consultation on the draft Delegated Directive amending Annex IX of Directive (EU) 2018/2001 on the addition of feedstocks for the production of biofuels and biogas. In our attached position we would like to adress several identified issues, which need to be resolved before finalizing the delegated act. The key aspects that require attention are: 1. Expanding the feedstock base in Annex IX part B should be followed by the elimination or increase of the annex IX part B cap. The same applies for the increase of sub-target for advanced biofuels and biogas if feedstocks are added to the list. 2. Avoid negative impact of reclassification of the feedstock which are already classified under Annex IX-A to Annex IX-B 3. Practical problems with implementation of certain aspects of delegated act - criteria not fit for use in food and feed chain; certification of damaged crops; intermediate crops definition, etc.. 4. Expansion of the feedstock base should include all feedstocks listed in Annex IV of Implementing Regulation (2022/997) Detailed reasoning and our comments regarding issues listed above can be found in the attachment.
