Response to Quantum Strategy of the EU

Quantum technology is poised to become the next breakthrough technology, with implications across the business and security landscape. Quantum sensing has already provided advances in sensitivity and accuracy, while quantum computing and networking may change the fundamentals of communications and cybersecurity. To secure a leading position at the forefront of the quantum industrial ecosystem, the EU must learn from past technology adoptions and build a robust, sustainable ecosystem of manufacturing infrastructure, critical components, and qualified operators. However, policymakers face challenges including security concerns and the need for post-quantum cryptography. A critical concern is the implications of cybersecurity in a post-quantum world. Commercially viable quantum computing technology is emerging, highlighting the critical need to safeguard the data of governments, businesses, and individuals. While a cryptographically relevant quantum computer may still be some years away, the threat of such a machine exists today as hackers harvest information now to decrypt later. It is necessary to fully understand the scope and urgency of this threat to address it fully. The EU must encourage its Member States to take proactive cybersecurity measures. The USAs NIST has published post-quantum secure algorithms, and the UKs NCSC has recently issued guidelines for UK companies to transition to post-quantum cryptography in alignment with NIST standards. A coordinated global initiative to enhance information security in a post-quantum landscape is vital. The EU should actively support and contribute to the development of interoperable standards and set adoption deadlines to prompt action by Member States to protect from the potential threats posed by advancements in quantum technology. Quantum technology offers real advantages beyond ultrafast decryption and ultra-secure encryption and communication. Building this quantum ecosystem requires systematically analyzing how quantum technologies can enhance existing solutions, such as biomedical research and logistics, as begun by the US DARPA Quantum Benchmarking program, alongside security applications. Each Member State must align their national quantum strategies with the EU Quantum Strategy to embed common goals, accelerate quantums contribution to other strategic priorities, and avoid protectionism. Despite unique individual strengths, no country can build a quantum industry without global integration. Furthermore, a deeper commitment to internal cooperation and alignment between EU policymakers, Member States and industry is critical to creating an ecosystem that plays to the strengths of each actor and avoids strategic fragmentation. The example of Extreme Light Infrastructure can serve as a model for future quantum development and computing facilities across the EU. Similarly, the development of critical component manufacturing facilities can take lessons from the semiconductor industry - ensuring that locations are chosen for proximity to industry leaders and provide secure access to these components for all Member States. Also, resolving IP ownership concerns for publicly funded research is essential, as government IP ownership may deter companies from pursuing government awards, stifling innovation and potentially accelerating a quantum winter, where startups fail due to prolonged development times and limited capital. Finally, an industrial ecosystem requires a holistic workforce to build, maintain, and operate it. While quantum companies currently hire a disproportionate amount of PhD scientists, an industrial workforce will require greater public comfort with the concepts of quantum science that underpin this technology and its sociopolitical impact. Upskilling the existing workforce with quantum technology training and promoting educational initiatives to make quantum concepts familiar to all will ensure a sustainable future workforce. Dear Sir/Madam EY Europe SCRL (“EY”) wishes to thank the European Commission (the Commission) for the opportunity to comment on its roadmap for a new comprehensive approach to preventing and combating money laundering and terrorism financing. We have set out in the attached letter what we believe are the current challenges and highlighted a number of possible actions that could be taken by the Commission to further prevent and combat money laundering and terrorism financing. These include; the creation of an AML specific supervisor, the proposal of a fully harmonized regulation and the consideration of the potential conflict of existing regulations and laws. Response to Fair taxation of the digital economy

We are responding to the European Commission’s March 21, 2018 Proposal for a COUNCIL DIRECTIVE on the common system of a digital services tax on revenues resulting from the provision of certain digital services COM (2018) 148 final (“interim measures” or the “Proposed DST”) and its Proposal for a COUNCIL DIRECTIVE laying down rules relating to the corporate taxation of a significant digital presence COM (2018) 147 final (“long-term solution” or the “Proposed SDP”). As noted in the attached letter, we believe that the appropriate country of taxation should be determined by international tax agreements. New measures, such as the 3% Digital Services Tax, top up the existing source-residence rules, therefore creating tensions with international agreements on divisions of taxing rights. For businesses who are already operating through taxable entities in the EU territory, the DST is simply a surcharge and will therefore give rise to double taxation, which clearly should not be the intended outcome of the rules. Moreover, we believe that the user platforms that would be subject to the DST are quite commonly used. This reinforces the OECD conclusion that the digital economy cannot be ring fenced. Many businesses that traditionally operated through fixed places, now (also) operate through platforms, including in the travel industry, the retail industry, and the media industry. We therefore believe that the calculations underlying the proposal significantly understate the number of EU companies that will be confronted with the double taxation created by the DST. For small margin activities this charge therewith will be prohibitive for their existence, or will be passed on to the customer. We therefore stress the importance of a thorough look at the impact on business operations and for any new measures to only be taken forward as part of a global dialogue.
