ELPHA vzw

to facilitate and promote, at the European level, the activities and the co-operation between associations and companies in the European Union with one of the following occupations: a. primary breeding, b. incubation and hatching of poultry eggs, c. the production of hatching eggs and day-old poultry, d. trade in and outside the European Union of hatching eggs and or day-old poultry to promote the interests of the members as weil as their rights and functions to address common issues in the European and international markets as a formal representation towards official organisations and institutions, particularly in the EU.

ELPHA, the European live Poultry and Hatching Eggs Association, would like to thank the Commission for giving us the opportunity to react on the draft Implementing regulation laying down certain rules for the application of Regulation (EU) 2018/848 of the European Parliament and of the Council as regards the documents needed for the retroactive recognition of periods for the purpose of conversion, the production of organic products and information to be provided by Member States. Our comments are available in the Annex document.

Response to Lists of diseases for Union surveillance programme and for disease-free compartments

ELPHA representing the European live poultry and hatching-eggs association thanks the European Commission for the opportunity to provide comments on the Consultation Animal health - lists of diseases relevant for surveillance programmes and disease-free zones in EU countries. We suggest Newcastle Disease should be considered as listed disease for which the disease-free status of compartments may be established. Newcastle Disease is normally not occurring in EU and if it is occurring immediate eradication measures must be taken (classified as “ A “ in the diseases list). Compartments grant safe and effective management and are of great help when restrictions to movements and trades occurs. Compartment scheme provides an assurance that member companies are free from both avian influenza (AI) and Newcastle disease (ND), even at times when there may be an outbreak of one of these diseases within the country.

Response to Animal health requirements for the entry into the Union of animals, products of animal origin and germinal products

The European Live Poultry and Hatching Egg Association (ELPHA) and the European Poultry Breeders Association (EPB) thanks the European Commission have a few extra comments on this consultation. With the large volume of new documents to review for the new Animal Health legislation it is very difficult to detect conflicting requirements in the different sections that are presented for consultation. It would be very helpful to have references to related pieces of legislation presented with each document. The following two points may be covered in other sections of the Animal Health Legislation but are very important points that may show a lack of consistency between sections. Imports from countries using HPAI vaccination Programme: Within the EU If any member state intended to run a HPAI vaccination program, the program should be submitted to the Food Chain and Animal Health Standing Committee for a final approval before starting it. In the same way any imports from a third country using HPAI vaccination should also get approval from the Food Chain and Animal Health Standing Committee. In Part II Title 3, Chapter 1, Section 2 (SPECIFIC ANIMAL HEALTH REQUIREMENTS FOR BREEDING AND PRODUCTIVE POULTRY), article 44 and Section 4 (SPECIFIC ANIMAL HEALTH REQUIREMENTS FOR DAY-OLD CHICKS), article 46 the draft This does not make any reference to the zoonotic salmonella such as S enteritidis etc. Does this require to be included here or is it sufficient to be covered in the Zoonoses legislation.

Response to Transmissible animal diseases — rules on prevention and control

AVEC representing the European poultry meat producers and ELPHA representing the European live poultry and hatching eggs association, generally support the draft Commission implementing Regulation on the application of certain disease prevention and control rules to categories of listed diseases and establishing a list of species and groups of species posing a considerable risk for the spread of those listed diseases. However, we have reservations on: - Salmonella arizonae: we believe that Salmonella Arizonae should not be tested in other species than turkeys. To our knowledge there is no evidence of specific problems with Salmonella arizonae except for turkeys; in addition, intra-Community trade and imports from third countries of poultry and hatching eggs1 are mentioning Salmonella Arizona monitoring only for turkeys. Therefore, we recommend the deletion of “Gallus Gallus” from the listed species. - For the sake of clarity we suggest including in the Commission Implementing Regulation and Annexes the definition of Salmonella arizonae laid out in COMMISSION DECISION amending Annexes II to IV to Council Directive 2009/158/EC on animal health conditions governing intra-Community trade in, and imports from third countries of, poultry and hatching eggs meaning: “Salmonella arizonae: meaning Salmonella enterica subspecies arizonae serogroup K (O18) arizonae” - Mycoplasma meleagridis: AVEC and ELPHA believe the monitoring of Mycoplasma meleagridis should be carried out exclusively for turkeys as requested in the EC DECISION of 1 April 2011 amending Annexes II to IV to Council Directive 2009/158/EC on animal health conditions governing intra-Community trade in, and imports from third countries of, poultry and hatching eggs. Therefore, we suggest creating a different line for Mycoplasma meleagridis and we recommend the deletion of “Gallus Gallus” from the listed species. - Low pathogenic avian influenza (notifiable H5/H7): we call on the Commission to link the categorisation of LPAI to OIE deliberations (Revision of OIE Terrestrial Code (Chapter 10.4.) including the consideration from the report of the ad hoc Group on Avian influenza). The categorisation should consider the possibility for third countries to require 'freedom from AI' or even 'freedom from notifiable' on a country basis.
