Response to Access to service facilities and rail-related services

Europorte thank the commission for its initiative and the last version of the delegated act. As already said in the various meetings, Europorte is in no way asking for exemptions for whatever party. Europorte is asking clarification of the notion of operators in the case that the facility may be owned, managed or operated by different entities. The purpose of this clarification is to avoid a dilution of the responsibility between the parties which could lead to uncertainty for customers and also the regulator and therefore potential claims. In the last draft of July 20 there is a new § 9 in the introduction : “Different entities may be in charge of deciding on access conditions for a service facility, allocating capacity in the service facility and supplying rail related services in the facility. In such cases, all entities concerned are to be considered operators of a service facility within the meaning of Directive 2012/34/EU. In addition, each of them should meet the requirements of this Regulation for the part it is responsible for. If a facility is owned, managed and operated by several entities, only the entities responsible for providing the information and deciding on requests for access to the service facility and use of rail-related services should be considered as the operators of the service facility.” We believe that this new text is to some extend contradictory. We would therefore suggest a new wording to be placed in between § 2.2. and § 2.3. - If a facility is owned, managed or operated by several entities, only the entities in charge of defining, deciding and publishing the information listed in article 4 should be considered as the operators of the service facility. We thank in advance the Commission to take our proposal into consideration.
