FFTélécoms welcomes the opportunity to respond to the public consultation on the White Paper "How to master Europe's digital infrastructure needs?" (hereinafter the White Paper). We commend the White Paper's commitment to addressing these challenges and ensuring European operators' ability to invest significantly and sustainably in digital infrastructures, which are crucial for the future of European innovation and competitiveness. Response to Child sexual abuse online: detection, removal and reporting

The French Telecoms Federation (FFTélécoms) represent the electronic communications sector in France. As dedicated companies, committed to the safety of our users, we are long standing partners of Law enforcement authorities, hotlines and NGOs, in the fight against CSAM. As such, we welcome the Commission's initiative to take this fight to the next level. However, the proposed framework creates significant conflict of Laws for operators, and raises significant technical questions. Furthermore, we are afraid that it would result in a system less efficient than the one existing in France. The attached document presents our suggestions to ensure that the future framework will be fully operational, present legal certainty for the parties involved, and proportionate.

Response to Revision of the NIS Directive

Established on the 24th September 2007, the French Telecoms Federation (Fédération Française des Télécoms, hereinafter “the FFTélécoms”) represents the electronic communications operators in France. Its missions are to promote an innovative and responsible industry with respect to society, the environment, people and businesses, to protect the economic interests of the sector and to promote the image of its members and of the profession on a national and international scale. In order to pursue these missions and with the view to the interests of its members, the Federation coordinates ongoing, structured dialogue among all industry stakeholders in both institutional and private domains. Furthermore, it ensures the highest standards of representation for the sector in issues of common interest, in accordance with competition laws in force. Its 18 members are Altice-SFR, Arteria, Bouygues Telecom, Colt Technology Services, Hub One, ield, IP Directions, La Poste Mobile, Legos, Manifone, Odigo, Orange, Prixtel, RATP Connect, Syma, Tofane, Verizon France and Worldline. As discussions develop in the EU Institutions, the FFTélécoms hereby sets out its preliminary position on the revision of the draft directive of the European Parliament and of the Council on measures for a high common level of cybersecurity across the Union, repealing Directive (EU) 2016/1148. The FFTélécoms warmly welcomes the introduction of new rules that aim at ensuring a high level of cybersecurity throughout the single Market. Especially, we welcome the educational measures foreseen by the text, as we feel the need to develop a solid culture of cybersecurity in Europe. However, we note that the draft directive needs to be improved mainly in the area of coherency with other instruments, notably such as the EECC. Furthermore, we call on the co-legislators to expand the scope of the text to software editors, as these should be subjected to the same high standards as other stakeholders in order to avoid any security loopholes. In addition, we fear that the proposed reporting obligations are not realistic and could even lead to a weakening of the overall security of electronic communications providers. At last, we note that only two years have passed since the effective implementation of the NIS Directive. A new framework always sets a high pressure on providers, both from a technical as well as from a financial point of view. In our view, this revision should be future proof and provide certainty to providers for years to come. Please refer to the enclosed PDF file for further information.
