Response to Virtual worlds, such as metaverse

Hermès International appreciates the opportunity to respond to the European Commission's call for evidence on its initiative on virtual worlds (metaverses). Please find our contribution in attachment. In a time where digital worlds become more present in the daily life of people, the opportunities for brands to expand their presence into the metaverse are both significant and inevitable. The capacity of brands to protect their intellectual property rights is the primary condition to protect consumers and promote continuously the reputation of brands. Hermès calls on the European Commission to define a framework for the protection of intellectual property rights in the metaverse: 1) Intellectual property rights established in the physical world should directly transfer to the virtual worlds; 2) The ownership of a trademark right with respect to a good or service in the physical world should automatically cover the use of the trademark with respect to a similar good or service in the virtual worlds; 3) Virtual world platforms should provide mechanisms for intellectual property rights owners to promptly and effectively take down virtual products that infringe intellectual property rights.
