Response to Greenhouse gas emissions savings methodology for recycled carbon fuels and renewable fuels of non-biological origin

Infinium Operations, LLC (“Infinium”) is a leading innovator in the clean fuels space with a mission to decarbonize the transportation sector and help mitigate the catastrophic effects of climate change. Infinium proprietary technology converts carbon dioxide and green hydrogen into ultra-low carbon fuels – known as Electrofuels – for use in today’s planes, ships and truck fleets. Infinium is actively developing projects globally in the European Union and Americas and is financially and strategically supported by its investors, including affiliates of Amazon, NextEra Energy, Mitsubishi Heavy Industries, AP Ventures, Neuman & Esser and others. Infinium supports a clear and reasonable methodology for assessing GHG savings for RFNBO that provides legal certainty as to the application of the Delegated Act without imposing unnecessary barriers to the investment of capital necessary to the development, construction and operation of RFNBO facilities. Furthermore, Infinium supports fair and non-discriminatory rules providing a level playing field for RFNBOs, whether production occurs in the European Union or in third countries for later import into the EU. Infinium supports the overall objectives of the draft Delegated Act but wishes to highlight critical issues raised by the language of the draft Delegated Act that will have far reaching and adverse consequences for the RFNBO industry – significantly slowing down and even crippling deployment of RFNBO projects. Among these concerns are the following issues: 1. Time limits on industrial CO2 sources 2. Allowability of industrial CO2 sources 3.
