Response to Savings and Investments Union: Directive fostering EU market integration and efficient supervision

Intercontinental Exchange operates a derivatives exchange and a CCP in the Netherlands. We are very concerned that the Commission is considering applying so-called "open access" to ETDs. This would have the effect of stifling product innovation in ETDs and would likely fragment trading liquidity, increasing costs for end users. As a consequence the EU would be a worse jurisdiction in which to operate ETD markets than other jurisdictions with which the EU competes in a global marketplace. For these reasons the policy was revoked for ETDs under the previous Commission.

Response to Interservice consultation on the electricity market design reform - REMIT

Intercontinental Exchange Inc., on behalf of itself and its subsidiaries (ICE), appreciates the opportunity to comment on the Commission consultation on Wholesale energy markets improving EU protection against market manipulation. In summary, ICE strongly recommends the Commission: Remove prohibitions and requirements related to financial instruments which are already subject to EU financial regulation (i.e. MiFID/R and MAD/R) and concentrate the REMIT on rules applicable to non-financial instruments (short term or spot contracts) subject to EU energy policy, preventing any duplication, overlap and uncertainty in the application, supervision and enforcement of these distinct legislative frameworks. Remove the proposal to require third country firms to have an office in the EU, as the requirement would act as a barrier to trade and may negatively impact the liquidity of European energy markets and the development of new, innovative products in the EU. Moreover, it would reduce the attractiveness for non-EU energy suppliers to export energy to Europe based on the price of European onshore energy products, as they would struggle with the office requirement and thus managing risk on European markets. Introduce provisions which allow for an orderly authorisation process of EU based Registered Reporting Mechanisms (RRMs) and the recognition of third country RRMs. We have attached our position paper on the review of REMIT which further elaborates on our recommendations, and we remain available for any questions you may have.
