Response to Establishment of the scientific panel of independent experts under the AI Act – implementing regulation

The Irish Council for Civil Liberties (ICCL) welcomes the opportunity to provide feedback on the Draft Implementing Act to establish a scientific panel of independent experts in artificial intelligence (AI). We compliment the European Commission for emphasising the absence of conflicts as a selection criteria in the Draft Implementing Act. The Commission's recognition of multidisciplinary expertise, including fundamental rights and equality, in the Panel is commendable. We make suggestions on three important aspects of the Draft Implementing Act in the attached document: (i) Conflicts of interest; (ii) Public transparency of the AI Offices decisions; and (iii) Effectiveness of the Scientific Panel.

We welcome the opportunity to provide feedback on the European Commission's White Paper On options for enhancing support for research and development involving technologies with dual-use potential. ICCL urges the Commission to choose Option 1 and strongly opposes Options 2 and 3. We provide additional detaills in the attachment.

Response to Liability rules for Artificial Intelligence – The Artificial Intelligence Liability Directive (AILD)

The Irish Council for Civil Liberties (ICCL) is Irelands oldest independent human rights monitoring organisation. We welcome the opportunity to respond to the consultation on the Artificial Intelligence Liability Directive (AILD). The AILD attempts to address the problems posed by artificial intelligence (AI) systems to the liability rules in the European Union (EU). However, the burden on victims remains too high in the proposed AILD. We have two recommendations to better protect victims: 1. Apply strict liability regime for all AI systems across the union. 2. Adequately address immaterial damages and societal harms. We explain our recommendations in the attached PDF.
