Response to Update of EU rules on audiovisual media services

Wir verfolgen die Diskussionen auf europäischer Ebene zur möglichen Öffnung und Reform der Richtlinie über audiovisuelle Mediendienste (AVMD-RL) mit großer Aufmerksamkeit. Wir sprechen uns gegen eine Öffnung der AVMD-Richtlinie aus. In ihrer gegenwärtigen Form hat sich die AVMD-Richtlinie als geeignetes Instrument zur Regulierung audiovisueller Inhalte innerhalb des europäischen Binnenmarkts bewährt. Sie schafft den notwendigen Rahmen für Transparenz, Fairness und Wettbewerb, wahrt dabei aber zugleich den notwendigen Spielraum für nationale kulturelle und medienpolitische Ausgestaltung. Im Weiteren verweisen wir auf die beigefügte Stellungnahme der Spitzenorganisation der Filmwirtschaft (SPIO).

LEONINE Studios, one of Germany's leading independent media companies covering the entire content value chain, urges to maintain the existing exemption for the audiovisual sector in the geo-blocking regulation. Geo-blocking is essential for the production, acquisition, financing and exploitation of audiovisual content and films, as it is the only way to ensure territorial exclusivity. Up to 60% of production financing comes from co-production agreements and pre-sales based on territorial exclusivity (FIAPF studies). In the area of licensing international feature films, the entire value chain depends on territorial exclusivity. This applies in particular to all EU Member States. All models reduce financial risk and promote cross-border cooperation. A ban on the use of geo-blocking would seriously jeopardise the creative and economic sustainability of the audiovisual sector. It would reduce the volume, variety and linguistic diversity of content produced, limit distribution not only within the EU and increase prices for consumers. An erosion of territorial exclusivity would have a significant impact on the audiovisual sector and consumers, with short-term losses of up to 9.3 billion per year and medium to long-term losses of up to 4.5 billion per year (Oxera study). EU markets are dynamic, diverse and rich in terms of content, services and access, as studies by the European Audiovisual Observatory (EAO) show. According to the EAO, consumers in Europe have access on average to over 8,500 European films on the Internet, 82% of which were produced in other European countries. This represents a significant increase in the availability and diversity of content for consumers in Europe and highlights the increasing cross-border distribution of European films via digital platforms. Geo-blocking is essential for the economic stability and cultural diversity of the European audiovisual sector. A ban would have a significant negative impact on the industry and consumers. We appeal to the European Commission not to call into question the existing exemption for the audiovisual sector in the geo-blocking regulation.
