Response to Evaluation of the 2011 White Paper on Transport

The Lithuanian National Road Carriers association LINAVA representing around 800 road transport companies is of major concern that EU's transport policy does not deliver in terms of free movement of services, the Single market and opening of the EU's road transport market. Actually, the current road transport policy is going to the opposite direction. It is due to the EU Member States protectionist measures as well as legislation introduced on the EU level. EU Member States unilaterally restrict the access to their national markets posing a great threat to free movement of transport services. To be precise, the situation in road transport market has been deteriorating due to the national legislation on posted workers (minimum wage laws) introduced in some EU Member States and ended up with excessive financial and administrative burden on drivers and hauliers. Moreover, the discussions about the fragmentation of the EU road transport market have become a dominant topic [at least among hauliers]. It‘s getting more and more worrying as a number of countries that have introduced unilateral measures on posted workers is rising. Lithuanian hauliers are deeply concerned about the ongoing debates on the Mobility Package 1. The proposals on a “split of international transport”, “return home of trucks” and “cooling off period for cabotage” represent a threat to the industries, lead to irreversible fragmentation of the European Single Market, as well as unequal treatment of drivers. It is unimaginable at all that such proposals as obligatory return home of trucks still manage to find its way through the decision making process. Most importantly, we see these measures discriminate against hauliers from peripheral EU member states. The Mobility Package 1 and some other initiatives that are being introduce on national and EU level will distort the Single Market, fair competition and level playing field as operators established in EU Member States of high industrial capacity as well as located closer to the major EU goods flows will find themselves in significantly better business environment compared to hauliers from the peripheral and less industrially developed EU Members States. The EU's road transport policy is getting more and more closed and restricted as ever before
