Response to Updating the list of infringements which may lead to the loss of good repute by the road transport operator

Amendment proposal of regulation 403/2016 Opinion by Employers Association Transport and Logistics Poland Changes to keep the EU provisions up to date are essential, it goes without saying. At the same time those changes should take into consideration also other regulations and market situation, especially during this difficult times for road transport sector such as driver shortage, vehicle shortage or pandemic restrictions. It is worth mentioning that road transport operators are being fined across the EU for every infringements detected. That means severe financial fines but also other of administrative nature. Categorization of serious infringements is another way of punishment for hauliers for the same infringements detected. Simultaneously, other EU pieces of road transport legislation state that “no infringement shall be subjected to more than one penalty or procedure”. Yet we have here clearly procedures for additional severe penalties for road transport operators for the same infringements… In addition, infringements listed in regulation 403/2016 do not take into account their nature, that is if they are committed intentionally or not, for instance by simple human error. We do believe this is crucial to determine the seriousness of infringements and further possible steps against road transport operator. Without clear distinction between intentional and unintentional infringements their categorization is simply not fair with regard to honest and law abiding operators. It is simply not possible to avoid the situation that every now and then their drivers commit some unintentional errors since they are just humans. The EU only considers fines and procedures against operators and at the same give nothing in return. Some kind of positive feedback and different approach should be also consider with regard to those operators who do a lot of efforts to act according to the rules, which is not easy these days.
