Response to Industrial Decarbonisation Accelerator Act

Lucid Motors, a United States-headquartered manufacturer of high-efficiency battery-electric vehicles (EVs) that has exported to the European Union since 2022, welcomes the opportunity to comment on the Industrial Decarbonization Accelerator Act (IDAA). The call for evidence indicates that the Commission is assessing the relevance of introducing, inter alia, minimum EU-content requirements in public (and, in some circumstances, private) procurement in strategic sectors. Lucid strongly supports the EUs goal of accelerating decarbonization yet considers compulsory origin-based content thresholds counter-productive and legally challenging. This submission explains: (i) why origin-based content thresholds would slowrather than speedthe EUs decarbonization effort; (ii) why such thresholds would likely conflict with the EUs obligations under various international trade treaties; and (iii) why performance-oriented criteria would be more appropriate.
