Response to Delegated Regulation amending Annex I of Regulation (EU) 2023/1115 (EU Deforestation Regulation)

As Lavazza Group, we would like to submit the following feedback on the Delegated Act: - Please confirm that marketing materials (or any similar relevant product) are to be considered out of scope also when, after their first placing on the EU market (import or manufactured in EU), they are made available on the EU market again after the import, on the basis of an agreement which does not entail transfer of ownership. - Please confirm that the exclusion provided for HS code 1802 Cocoa shells, husks, skins and other cocoa waste: "(not including waste as defined in Article 3, point (1) of Directive 2008/98/EC)" applies also to HS code 0901 Coffee, whether or not roasted or decaffeinated; coffee husks and skins; coffee substitutes containing coffee in any proportion, as far as "husks and skins" are concerned. - Please confirm that products falling under the HS code 4410/4411/4412/4413 or 47/48 and 49 are to be considered out of scope when manufactured exclusively with waste of production (rif plywood or chipboards) - Please confirm that the inclusion of soluble coffee will be addressed as soon as possible, preferably before the next review of the regulation planned for 2028.
