Response to Revision of the 'New Legislative Framework'

Amazon welcomes the opportunity to contribute to the European Commissions preparatory work on the revision of the New Legislative Framework (NLF). We believe that this presents a unique opportunity to update the product policy framework to adapt to digitisation, support circularity, and create a legal framework which guarantees that products reaching EU consumers meet the highest safety standards. Our recommendations for an NLF which supports EU consumers and businesses in the digital age are: 1. Unlocking the potential of Digital Product Passports (DPP): The DPP should become the single source of truth for product information. The DPP can help unlock the EU single market, reduce compliance costs and waste, and support consumers with multilingual information. The NLF should create a framework for distinguishing between essential and non-essential product information and pave the way for the DPP to replace physical labelling. DPPs should be accessible via a centralised data hub, enabling data mining by end users, accessibility and personalisation for consumers, businesses and authorities, and be fully interoperable with other existing reporting databases. The NLF should ensure a streamlined approach to DPPs and avoid any diverging requirements across different pieces of product legislation. 2. Supporting Circular economy goals: The NLF needs to be updated to introduce harmonised EU definitions for new terms such as repair, refurbishment, and re-manufacturing; avoid the creation of new or overlapping market barriers for sustainable goods such as country-specific scores (e.g. repairability indexes); support sustainable services through reduced VAT rates for refurbished and second-hand products and favorable VAT treatment for product donations; and adopt a digital one-stop-shop for EPR compliance. 3. Enhancing enforcement of product policy: The revisions of the NLF and Market Surveillance Regulation (MSR) are critical opportunities to kick off an ambitious reform of the overall enforcement approach through a "smart enforcement" strategy, ensuring fair treatment across all channels, clear responsibility distribution, and proportionate enforcement measures. The NLF should create a plan for the deployment of advanced tech tools in enforcement. 4. Ensuring the Responsible Person role is meaningful: The revision of the NLF is a key opportunity to strengthen the Responsible Person (RSP) role to ensure product safety in the EU. The RSP position should be strengthened through professional accreditation, creation of a verification database, and expanded responsibilities including safety monitoring and recall management.

Amazon welcomes the European Commissions draft implementing regulation on the interoperability of the Safety Gate Portal for providers of online stores and online marketplaces and are committed to supporting the Commissions efforts to enhance efficiency and automation in issuing public recall notifications. In order to support a successful collaboration, we would request more detailed information regarding the technical requirements to enable this interoperability (e.g., API documentation or other technical specifications). In order to allow online marketplaces to link their interface to the Safety Gate Portal and make use of the interoperable interface of the Safety Gate Portal, industry needs additional information and technical details on this interoperable interface system in order to build the technical infrastructure.

In light of Amazon’s strong commitment to our customers and sustainability practices, we welcome efforts to make products increasingly recyclable, restrict single-use, and counter premature obsolescence. Setting up a framework for ecodesign requirements, an EU Digital Product Passport, and introducing restrictions on unsold consumer goods under the new European Commission’s proposal for an Ecodesign for Sustainable Products Regulation (ESPR) will ensure that all products placed on the EU market will increasingly become sustainable and accelerate the transition to a climate neutral, resource-efficient and circular economy. With these goals in mind, the attached document outlines a number of aspects of the new proposed rules, which we believe might need to be considered by the co-legislators when adopting the final legislative text.

The European Commission's initiative on empowering consumers for the green transition will be an important element to create a level-playing field, improve consumer protection against unfair practices and ensure they are empowered to make informed sustainable choices. They want any new requirements developed within the existing Ecodesign framework, and propose digital product information tools to reduce administrative burdens. They also seek VAT relief for donations of unsold goods.123
Why — This would avoid mandatory compliance costs and allow flexible, voluntary adoption of standards.45
Impact — Environmental groups lose stronger mandatory requirements that would force faster product sustainability improvements.6
