Response to Update of EU rules on audiovisual media services

Middle Tech Europe (MTE) is a growing alliance whose members currently include Automattic, Dailymotion, Discord, Dropbox, Patreon, Pinterest, Reddit, WeWard, Yahoo, and Yubo. Our members operate a wide variety of services, ranging from video-sharing and e-commerce to e-mail, forums, communication, media, and hosting services representing the often missing middle-voice in tech policy discussions. We strongly support the Commissions objective to "simplify or streamline AVMSD rules" to ensure they remain "fit for purpose". And while we understand that this review is part of a statutory schedule, we also present our feedback in the context of the Commissions simplification and competitiveness agenda. Our submission focuses primarily on the overlap between the AVMSD and the DSA regarding Video-Sharing Platforms (VSPs). Please see the attached file for our detailed feedback.

Positioned between the tech giants and smaller startups, our members operate a wide variety of services ranging from video-sharing and e-commerce to e-mail, forums, communication, media, and hosting services - representing the often missing middle-voice in tech policy discussions. MTE welcomes the opportunity to provide feedback on the Commissions consultation on the upcoming Digital Fairness Act (DFA). We are happy to be able to provide the perspective of a diverse range of mid-sized companies seeking to ensure that the regulatory approach is consistently proportionate, adaptable and relevant to all the online players in scope and ensures a harmonized, consistent and clear legal framework for businesses. Our members operate a wide variety of services, ranging from video-sharing and e-commerce to e-mail, forums, communication, media, and hosting services representing the often missing middle-voice in tech policy discussions. Regulatory coherence and simplification is particularly important for midsized companies, which often lack the extensive compliance teams of the largest competitors. This is why Middle Tech Europe is keen to actively contribute towards the common goal of streamlining the digital acquis and advocate for a proportionate and flexible regulatory approach to the digital sector. With this response, MTE is providing input on key areas where our members see potential to reduce bureaucratic burden: Artificial Intelligence, Cookies, the Digital Services Act and its interactions with other pieces of legislation, Incident reporting and Future tech policy-making.
